USC married UKC
« on: December 22, 2018, 07:41:33 AM »
Sorry for the simple question, just beginning to dive into this topic...

I am a US citizen working for a US company and I recently got married to a U.K. citizen who is self employed in the U.K.  we are working on the spouse visa now and I hope to be moving over there next year.

We have no joint bank accounts.

For the 2018 tax return in the US - do I file as married filing separately? Anything special I need to do?

Does he need to file any kind of US form? I would assume no as he has no financial ties to the US, but I want to be sure.

You'll file as you normally do but selecting married filing separately. You put that he's a non resident alien and has no SSN on the forms where it asks for the spouses details. It's not too hard, the software you use should allow for it. I'm assuming you're US resident for the full tax year and he was living and working in the UK during that time?

You might want to run the numbers on the basis you both elect to file jointly - to see if overall the tax is lower than filing separately after he claims foreign tax credits.
