WEP again
« on: December 16, 2018, 10:44:31 AM »
Sorry but I just need a clarification. US citizen living in UK. I qualify for US social security. Will my award be affected by the WEP rules due to the fact that I am receiving a UK work based pension that I contributed to including paying in substantial AVC's.? It is not a "public" pension in my eyes. Many thanks in advance.

Yes, I believe WEP does apply.  I am in a very similar situation myself and will be applying for US SS in a few years.

Released: November 2015
BACKGROUND:The Windfall Elimination Provision (WEP) is a formula used to adjust Social Security worker benefits for people who receive “non-covered pensions” and qualify for Social Security benefits based on other Social Security-covered earnings.a A non-covered pension is a pension paid by an employer that does not withhold Social Security taxes from your salary, typically, state and local governments or non-U.S. employers.

How many years of substantial US SS contributions do you have?

If it's 30 or more years, WEP will not be applied. If it's less than 30 years, WEP will be applied. If it's 20 years or less, Max. WEP may be applied. Much depends on individual circumstances.

You may calculate your situation using the following calculator:

I only have 16 years of substantial contributions. My application was being processed when I asked the question. I received my award a few days ago and yes I was WEP'd. Thanks for the info.
