Another Question Sorry
« on: July 29, 2019, 04:58:38 PM »
Hi all, I have another question as this is new to me...sorry. We are close to getting ready to apply. I am sending her the supporting documents and then we are applying. Is what happens next the correct way or not:

1.    We need to fill out Appendix 2 form
2.    When she needs to make an appointment, she will select her center closest to her which according to the GOV site is in West Virginia
3.    She will take all her documentation along with her to the center when she goes to get her biometrics done

Now this is where I get confused. Will she still have to send the documents to New York or will they be digitally sent?
If she uses this local center in West Virginia, can she still do the priority process to get it done quicker?

Also another question, where we are staying with my parents is a council house where they have been tenants for 42 years. Do I need permission from my parents or from the council to include with the visa application?

Sure I am missing something, but thanks for your help in advance.

Thanks again.

Anthony

Bump! Contacted the council and apparently they don't get involved in immigration and won't re-issue the tenancy agreement. My parents moved in 42 years ago so obviously it got lost along the way or they think they werent given one back in 1977. Will this be an issue?

Thanks.

Who owns the home?  Do your parents own it or does the council?

Then you'll need a letter from the council stating that your partner is allowed to move into the home once her visa is granted and that the home will not be overcrowded.  They are likely very used to this type of request.

Alternatively, if your parents have a copy of their tenancy agreement that states they are allowed to have up to xxxx number of people without requiring permission, that would work but it sounds like they don't have a copy of the agreement?

Thanks for the reply. My parents never had a tenancy agreement when they moved in back in 1977. And the council said they won’t write a letter as they don’t get involved in immigration. So it looks like we can’t apply for a visa then since I need this information

They should be able to provide the letter. Have you only spoken to the one person? Try again, hopefully you'll get someone else who is more obliging.

Thanks for the reply. My mam tried twice and they said they don’t get involved in Immigration matters, so won’t provide a letter. Maybe she will try again tomorrow for us. But this is the only obstacle I can see standing in our way.

I thought a letter from my parents would be enough as it is a 2 bedroom house and only my parents in one room and me in the other, so overcrowding is not an issue. I stay there as I am a carer for my dad.

Thanks again

Keep calling the council until you get someone who will write the letter.  Squeaky wheel and all.

Remind them you are not asking them to write a letter for immigration purposes - just to state facts.  That your partner is allowed to live in the home.  The home has two bedrooms and xxx reception rooms and therefore with 4 occupants, it will not be over crowded.

That is truly all they need to say.  Doesn't have to get anymore involved than that.

Which borough is it that is giving you grief?
