Ok, I'm ready....Deep breath....First FLR(M)
« on: January 15, 2019, 11:08:56 AM »
I started the application process....brief summary...and reminder of our situation.

Came here on a fiance visa in August...Married in november.
Hubby is financially exempt because of disabilities....We understand we still need to provide evidence of his disabilities, budget, banking statements. We have a general idea what we need but if anyone can help with a checklist to go by I WOULD BE SO GRATEFUL!!!

We did use a solicitor for the fiance visa and chose not to get one this round...Is this a mistake? Should we get one or do you think we will be fine without?
Thank you in advance.

We usually only recommend a lawyer if you have a serious criminal conviction or an overstay of a visa.  If you don't fit either of those categories, absolutely no need for a lawyer.  :D

Feel free to post a list of what you are sending and we can review it for you and ensure you aren't missing anything.

This is the guidance you need to be looking at.

FLR is barely any different in requirement to your initial visa with the exception of your marriage certificate instead of your wedding planning evidence and the addition of mail in both of your names.   :)

Ok, so I have reached a point in the FLR(M) application where it is asking about my husband son....here is the question..

"Does Mr XXXXXX XXXXXXX XXXXXXXX have any other children in the UK that are not applying on this application? "

When it asked me the same question it included if the child was 18 or under...I have no children so obviously, no. Hubby son is 18...lives on his own.  but doesn't ask if he is a minor. We at first answered yes because he does have a son. but they want the mother of the of hubby son utility bill and her birth certificate...etc.

do we answer no to this question because he is no longer a child. he is a adult and has nothing to do with our application and he is an adult...Help...I am a baffled by this.

I had a look at the questions, and I am just as confused as you are.

To summarize:  Mr. LivingInWales has an adult son from a prior relationship, who is living independently.  The son is British from birth, and nothing to do with the application.

For the applicant, the application asks:

Do you have any children of 18 years old or under?
    No

For the applicant's sponsor, the application asks:

Does PARTNER have any other children in the UK that are not applying on this application?
__   Yes (provide a whole bunch of stuff, including name, nationality, date and place/country of birth, gender, relationship status, who the child's other parent is, utility bills of other parent, birth certificates of both of the child's parent, etc.), or
 __   No

No seems wrong, but saying yes and having to provide all of that for an adult offspring seems ridiculous.

It is ridiculous, but when has logic ever been at the forefront of UKVI?

I would include a copy of the son’s birth certificate, passport, and a utility bill in his name at his address.  Then it’s done and you move on.

He does not have utilities bills as he just turned 18 years of age and everything is provided for where he lives. If we need his passport and birth certificate we can get it. easy enough.
We did answer the question with a no because  we and his mother have no financial or responsibilities for him as he is self sustaining himself. and he is an adult.

Just note all of that on the application or in a cover letter.

I wouldn’t answer no, as he DOES have a child.  But that’s me.    :)

As for them asking about the mother, and wanting  personal information about her, utilities from her and her birth certificate, just replace it with his information?

I would put yes to child.  Then fill in any information you have (if where the mom lives is unknown, just say so).  Then when you have a spot for additional information, say that he has a son, who has reached the age of majority, and. That he lives at xxxxx address.
