Question re: date on BRP for FLR
« on: May 29, 2019, 12:10:46 PM »
Hello everyone once again,

I have now had the opportunity to look at my D-I-L BRP after her successful FLR application.

However, despite trying my best to work out the following to no avail I thought it best to come to you for guidance once again.

She entered UK on 15 October 2016 on spouse visa

Her FLR was issued on 8 April 2019

The "valid to" date is 5 November 2021.

If this is a 5 year (60 months) process, why is the valid date not 15 October 2021?

Is this correct?

I am sure there is a simple straight forward answer but I cannot fathom it out!

PS

1. If the November date is correct then when would the 2 year document collection start from.

2.When would the correct time to apply for ILR

Thanks again

The date the BRP is valid until is dependant on when she applied for her FLR. It's 5 years to ILR but there is usually (depending on when the applicant entered the country first and when they applied for FLR) a fair bit of leeway. Nothing to worry about!

She is eligible to apply for ILR from 28 days prior to the 5th anniversary of her entering the country and must apply before the BRP expiration date.

Just keep all the mail in case they change the guidance at any point and give them what they ask for when the time comes. :)

It’s not an exact 60-month process... the date the visas are valid for will depend on when you applied, and when they were issued.

As long as the FLR(M) is valid long enough for her to apply for ILR before it expires, it doesn’t really matter what the end date is on it.

She has been lucky and has been granted her visa for longer than she needs it, which gives her more leeway to apply for ILR in 2021.

If she entered the U.K. on 15th October 2016, then she can apply for ILR as early as 17th September 2021.

And because her visa is valid until 5th November, she has until 5th November to get her application in, instead of only having until 15th October.

So, this is a good thing and nothing to worry about at all.

Hello again,

I have just seen a reply from I think Ksand24 that the proof of address (ie addressed mail) should cover 2.5 years and not 2 years as per FLR.

Is that correct?

Thanks

Yes, I believe that's how the ILR form reads at the moment. It could change with the next iteration of course but as long as you keep everything, you'll be covered either way.
