Spouse Visa - Refusal Question

Hello everyone,

It has taken quite a bit for me to post this request for advice, as I have a heavy pit in my stomach to even think about it, so please be kind in your responses as I know we should have submitted some things differently, but it is too late for that and I just need to know how to move forward.

I received a refusal on June 20th for “missing” bank statements, which is false as we provided 12 months showing my husband’s salary deposits that matched his payslips. I even received my package back last week (which looked as though my docs were tossed up in the air and scooped into a pile), and found that those statements were in fact in there and I now have video evidence proving it.

So, the refusal stated that we did not provide “ANY bank statements”. The catch is, and why I believe they were overlooked was that they were only 2 pages long, as we filtered them to show only the deposits (I know, I know now, we should have submitted the whole thing so as not to be in this position...I am paying the consequences). Those statements were on letterhead and stamped and signed by the bank, with all of his bank account information (which we even confirmed with the bank that what we used is official and used as evidence of income). And the point is they said we did not submit ANY statements, which is untrue. Plus we provided exactly (perhaps too exact) what was asked for, “statements corresponding to the same periods as the payslips at paragraph 2(a) showing that the salary has been paid into your sponsor’s account”.

Ok, so we contacted my husband’s MP immediately and have been told that they have reached out to the Home Office requesting a review on our behalf and attached the bank statements that they missed. They said we may have to wait 4-6 weeks for a response.

We only have 28 days if we want to appeal, which I don’t because that could take up to 2 YEARS? From things I have read...

I’m just having trouble sitting still, and just worrying about everything 24/7, and hating myself for not having done this better.

Is there anything more I can do? Should I speak with a lawyer? Should I reach out to anyone else? Or just wait for a response from the MP?

So sorry to hear about your refusal .

Unfortunately, because you didn’t provide full bank statements, they could not count any of the bank statements for the visa.

The bank statements must cover every single day of the 12 months you are relying on for the payslips, so you need a full 365 days of payslips and a full 365 days of corresponding bank statements. If you are even 1 day short of a full 12 months, the visa can be refused .

So, I doubt an appeal will be successful because you would need to prove that you provided full and complete bank statements, covering every day of the 12 months, but that UKVI ignored them.

Also, an appeal can take several months, possibly up to a year (haven’t heard 2 years before though), so I think your best bet would just be to wait the 4-6 weeks for the review and if that doesn’t provide any results, just reapply for the visa, this time providing the full bank statements for each month.

I agree with ksand.   UKVI *may* decide to be lenient due to your MP involvement but an appeal won't be successful.  The administrative review (which is what your MP triggered) is your best bet.

Thank you for your honest replies. This has actually helped a lot, even if the refusal stands. At least I can decidedly say I will not be appealing, and my plan B is to just reapply, with full and complete statements. You best believe I won't be skimping out on those! Well, here's to hoping I get a reply from HO soon, so I can make a move one way or another.
