It has taken quite a bit for me to post this request for advice, as I have a heavy pit in my stomach to even think about it, so please be kind in your responses as I know we should have submitted some things differently, but it is too late for that and I just need to know how to move forward.
I received a refusal on June 20th for “missing” bank statements, which is false as we provided 12 months showing my husband’s salary deposits that matched his payslips. I even received my package back last week (which looked as though my docs were tossed up in the air and scooped into a pile), and found that those statements were in fact in there and I now have video evidence proving it.
So, the refusal stated that we did not provide “ANY bank statements”. The catch is, and why I believe they were overlooked was that they were only 2 pages long, as we filtered them to show only the deposits (I know, I know now, we should have submitted the whole thing so as not to be in this position...I am paying the consequences). Those statements were on letterhead and stamped and signed by the bank, with all of his bank account information (which we even confirmed with the bank that what we used is official and used as evidence of income). And the point is they said we did not submit ANY statements, which is untrue. Plus we provided exactly (perhaps too exact) what was asked for, “statements corresponding to the same periods as the payslips at paragraph 2(a) showing that the salary has been paid into your sponsor’s account”.
Ok, so we contacted my husband’s MP immediately and have been told that they have reached out to the Home Office requesting a review on our behalf and attached the bank statements that they missed. They said we may have to wait 4-6 weeks for a response.
We only have 28 days if we want to appeal, which I don’t because that could take up to 2 YEARS? From things I have read...
I’m just having trouble sitting still, and just worrying about everything 24/7, and hating myself for not having done this better.
Is there anything more I can do? Should I speak with a lawyer? Should I reach out to anyone else? Or just wait for a response from the MP?
