FLR (M) 2nd extension confusion
« on: July 03, 2019, 05:44:29 PM »
Just wanting to stay on top of documentation prior to my 2nd FLR M to avoid as much panic and stress as possible, but I'm confused about the dates on my BRP.  I applied for my fiancé visa on July 11th 2018. Received it Oct 4th 2018, flew to England Oct 5th 2018.  I went back to the US for a few weeks and flew back to Edinburgh on Nov 7th, got married Nov 8th 2018.  I used the in person service (one of the last lucky ones) and received my FLR M on November 16th 2018.

My BRP says date of issue November 16th 2018 and expires June 13th 2021.  Thats only 31 months, isn't it suppose to be 33 months?

No. It isn't meant to be for 33 months. That is only for entry clearance applications as a spouse (which in itself is a hangover from when the visa was issued as a vignetted in your passport). FLR(m) is generally issued for 30 months, because 30+30 = 60 which is the number of months needed for ILR. So it looks like you're all good!

So May 17th 2021 is the earliest I can apply?

What happens if you can't produce something required for the 2nd FLR M.  We experienced this issue with my fiancé visa.  My husbands company is unable to produce a CT600 until September every year due to late payments from clients.  The UKVI was willing to delay my application until we were able to produce the updated CT600 instead of deny my application but this was only for a month.  I don't see them willing to delay my application from May until September.  So what will happen? Do they just kick me out of the country?

If you are applying under one of the self employment categories, you would use the previous full tax year, regardless of what month you apply. And no, they are HIGHLY unlikely to kick you out, but could put you on a 10 year path instead (but again, this is highly unlikely, provided you meet the terms of the visa).

Additionally, any employment income you might have could be counted. So if you qualify through employment, you would just use that income.
