FLR (M) Renewal: Emergency Situation

Hi There,

I have finally gathered all the documents I think I need to apply. I was very confused about the 28-day rule where you are not allowed to apply until 28 days before your current BRP Card expires or else they may add more time to your extension. A few weeks ago I found out that my grandmother had another massive stroke and is on a ventilator back home in the US. She may not have long to live and this has thrown me into a very severe depression. I am trying to gather the documents before completing the application but it is so difficult. I believe I have them all:

Required Documents:
-My whole Passport
-My Previous Passport
-My Husband's passport
-Copy of my current BRP Card
-Copy of the 1st BRP Card that I had before I updated the name

Proof of Accomodation:
-Our Joint Tenancy Agreement (this was signed by us and the Landlord electronically because they dont use paper copies any more)
-The inventory of the apartment that they conducted when we first moved in (February 2019)

Financial Requirement:
-My Husband's Payslips Showing an annual income of 21,000 GBP per year January 2019-October 2019
-Bank statements from Natwest that are mailed to us from 02 January 2019-02 Novemeber 2019
-Employer Letter from SSE confirming position and pay
-My payslips from showing an annual income of 19,544 GBP per year from January 2019-October 2019
-Bank Statements from Natwest that are mailed to us from 13 January 2019-13 November 2019
-Employer Letter from Bristol City Council confirming my pay and position.

Proof of Living Together: Joint Names

-Council Tax Bills (3 dated October 2017, April 2018, February 2019, and April 2019
-SSE Electricity Bills (dated October 2017, February 2018, October 2018, January 2019, and February 2019)
-TSB Joint Bank Account Statements (June 2019-October 2019)
-Gas Elec Appointment Confirmation

Additional Documents:
-Decree Absolute from husband's previous marriage
-Proof of payment letter for a court judgment I had in the USA that was paid off

Do you think this is enough to satisfy the visa requirements? Are there more documents I should add. I am really struggling with my mental health and I am not sure if I am doing this correctly. Is it possible to get an extension due to my health and circumstances.

Very sorry to hear about your grandmother.

Before getting into all the evidence, when does your BRP expire? Did you enter the country as a spouse or on a fiancee visa? On which date did you enter the country?

You can apply for FLR at any time but if you apply too early, it could mean that you would need to make an extra FLR application to make the time required to make the 5 years to ILR.

The only way to extend your visa is to apply for FLR.

Thank you so much for the reply. I entered on a fiancé visa 3 years ago. I entered the U.K. on 2nd December 2016. I switched to a spouse visa which was granted on the 6th June 2017. My current BRP card expires on 6th December 2019. I was confused about the dates I had to apply by because I do not want to apply for another FLR visa and just wanted to have the FLR for the required 5 years. I am going to apply by the Sunday and use the priority service to get my decision quickly. I just want to make sure I have everything before spending over £3000 and submitted the application.

Thanks for clarifying.
You do need your marriage certificate.
You don't need the inventory.

You only need to provide evidence of one of your jobs.

The employment letter should contain.

.(b) A letter from the employer(s) who issued the payslips at paragraph 2(a) confirming:
(i) the person’s employment and gross annual salary;
(ii) the length of their employment;
(iii) the period over which they have been or were paid the level of salary relied upon in the application; and
(iv) the type of employment (permanent, fixed-term contract or agency).

The latest bank statement, pay slip and employers letter should all be dated within 28 days of the date of the online application.

If the payslips are electronic and you have printed them yourselves, they need to be authenticated by letter, by your employer.

The correspondence evidence should be evenly spaced over the last 2 years, so roughly every 4 months.

Hi Larrabee, thank you for this. The payslips are mailed to us on the company letter head. The bank statements for me come at weird times during the month. I get paid on the last day or every month and my husband on the 23rd. The bank statement I receive come on the 13th of every month and my husbands on the 2nd. He will get another payslip this week sometime but this will not be reflected on the last mailed bank statement so we will have ones printed and verified at the bank when his pay hits his account. I see what your saying to only include one income because two complicates things but it’s so difficult communicating with my husband’s  HR  department for a new letter if the one we already have is dated before 28 days on Sunday. My most recent bank statement does not reflect my pay for this month which won’t come in until the 30th November. Which is after I intend to apply.

I am also still confused about the correspondence. Is it every 4 months from the same company or organisation or every 4 months a joint letter is sent in general. The letters I have are from 4 different places but the dates are sporadic. Should I include more evidence of the indivisible mail that we get but I will have more items than my husband because he doesn’t get a lot of mail.

I also read somewhere that we have to prove that the accommodation is suitable for two people. Would that be satisfied by the inventory or is the signed tenancy agreement enough to satisfy the requirement?
