Advice needed - should we move back to the US?
« on: January 10, 2020, 02:21:42 PM »
Hello, everyone! I'm needing some honest advice/opinions.

I moved to Scotland one year ago to be with my husband and have been struggling with settling here ever since. I have some very sick grandparents and an uncle with stage 4 pancreatic cancer that I left behind and the guilt of being so far away in their time of need has consumed me. I used to suffer from severe panic attacks in my late 20s/early 30s and they had all but gone away up until I moved here. Now I am having them on a weekly basis. I absolutely hate my job here and the fact that I am making half of what I was in the US doing the same thing is hard for me to stomach. In fact, all the jobs in my field pay signifcantly less here.

An opportunity has arisen for my husband and I to move back to the US and I am having a hard time weighing our options. He has been offered a voluntary redundancy package through his work which would pay him out a lump sum of one year's salary plus everything he has accrued in his pension the last 15 years. He wants to jump at this opportunity and use a portion of the money to move and get established in the US. What I am struggling with is whether it is the right move at this time. The one and only reason I could ever see us moving back to the UK is if his parents were to become ill and need some type of full-time care.

My question is, if we were to leave prior to me getting ILR or citizenship, would I still be eligible to reapply for a family visa in the future? I realize we would be starting from scratch, but is it even a possibility? Someone told me it looks bad on an application if you had one previously, left to go back to the US, and then tried to move to the UK again. Is this the case?

If the time is right for you now, go for it.  :) It will not at all be detrimental for future applications.

Thank you :) We just don't know if this opportunity to walk away from my husband's work will arise again so it seems like this may be the best time. We just wanted to make sure we could come back to the UK if it was absolutely necessary. Am I right in that the first step in the process for him would be for us to petition from the embassy in London?
