FLR(M) questions
« on: December 08, 2019, 03:37:36 PM »
Hello,

I'm going through the online application right now and have a couple of questions. I'll keep it all in this thread so as not to cause confusion.

  • Based on another thread, I am confused whether a single speeding ticket (resulting in a fine, but no penalty and no driving disqualification) should be logged under the Convictions and offences section of the online form? I do seem to recall that it was advised this did not need to be added to the original spouse visa application -- and looking back at my saved application, I didn't register the ticket there. Is the guidance different for the FLR(M) application, or have I made a mistake?
  • My husband owns our flat and the mortgage is in his name. Do I put that I "neither own nor rent" the accommodation, and then explain that he owns it? Do I confirm that I will submit any or all of these documents: Proof of property ownership from the owner of the property you live in, such as a mortgage statement; Copy of an ID document of the owner of the property you live in, such as a passport; Letter signed by the owner of the property you live in stating that you have permission to live there? I have ticked "yes" to the first two items, but thought I did not need to submit a letter since it is my husband's property and not a landlord from whom we rent.

1- It all depends on how the question is worded. From recent comments on the forum I believe that it asks for fixed penalty notices to be declared if there are 3 or more.

2-I would check that you own and explain that the property is in your husband's name.

I have always been advised that you need to supply the land registry as proof of ownership. What did you do last time?

Last time, the application was differently worded! Of course I am submitting the land registry deed and most recent mortgage statement, but was a bit tripped up by the wording. I am finding the application very confusing.

I have put "own" however and will add a clarification note in my covering letter that the flat is in my husband's name, as well as the mortgage.

I will not log the speeding ticket in that case, Larrabee, as I have not had more than 3.

I have a question about the declaration. Does my husband need to sign both Part 2 and Part 3? Is he a third party sponsor? I'm again confused by the wording on the forms.

As a follow up:

"Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?"

Do I put "yes" to this, because I have supplied joint bank account information and utility information that is in both my and my husband's names?

"Does the account with the bank or utility company for which you have supplied information and supporting documentation relate to another person who is to provide you financial support?"

I'm not sure what to put for this. Do I put "yes" for the reasons I listed above? Or is this a "no" because "another person" means someone other than my husband?

So sorry for the 20 questions!
