Driving offence question for new online form
« on: December 07, 2019, 02:36:49 PM »
Hi everyone.
Just looking for some advice as to the best way to input previous driving offences from before I moved here on the new system. With the old forms, I just ticked "yes" on the questions and then wrote a full explanation on my attached document and included my last 10 year driving record. On the new system, it wants you to input everything individually.
First off....it says this: "You must tell us about fixed penalty notices (e.g. a speeding or parking ticket) if you've received three or more."

I have technically received more than three, so this doesn't apply to me. I just thought other people might find it useful. Also, everyone should keep in mind that there is a 500 character limit for the explanation. Really unhelpful :-(

So for me, I have a couple questions just because one offence ended up landing me with two suspension. (Its not as bad as it sounds, I promise! I was also a young driver, and have definately learned my lessons.).

First, on the form, it asks you what your driving offence was and gives three options: disqualification for speeding, no insurance, other. So my question is just about the wording....if I had a speeding ticket but my license was not suspended, would I put "disqualification for speeding" or "other" and explain the other?

Next, it asks for the penalty date. Well, unfortunately in 2009 I did not realise I had entered an active work zone (I swear, there were NO flashing lights on the first sign, no workers around, AND it was a sunday....god, I hate the PA turnpike). Even the cop who pulled me over tried to get me to give him a valid reason not to give me a ticket, but I panic with authority. Anyway, I was going twice the work zone limit so not only is it a speeding ticket, but that particular offense is an automatic 15 day suspension and 5 points. On my driving record, the date of the violation was November 4th, but the "conviction date" was Nov 12th and the suspension effective date was Dec 28th.

My first question is....should I list this event as one event or two (speeding ticket and suspension)? If one, which date should I put?

And then, unfortunately, this led to a second suspension of my license. I had an accident earlier in the year (no one injured). I was too close to someone when they broke hard, and I hit her bumper (barely). But she was took close to the RV in front of her, who braked suddenly to turn right. So me bumping her pushed her into the RV. A local called the cops, I panicked thinking I was fully to blame and accepted full blame...landing me with "careless driving" and 5 points. So, I had 10 points in one year = 15 day suspension.

There is also another speeding ticket that is not on my driving record cause it was out of state. I've always addressed it in my explanations, and I remember it was in March but I do not know the exact date of it. Any suggestions?

Also...soooo unfair there are only 500 characters? Has anyone found a way around this?

Seeing as there are a lot of things that you're going to want to explain, I'd write a separate physical letter just for this section. Then in the 500 character explanation box, just refer the reader to your letter. Then just upload it with the rest of your evidence.

ps Never admit fault at the scene of an accident!

Unless you have the exact date, just put as close as you remember. I got a caution for speeding once but I can't for the life of me remember when. I picked the first of the month (form wouldn't let me leave the day blank) and just explained that I knew it happened in October 2010 but I was unsure of the exact date.

Ha...lessen well learned. My dad looked at the photos I took, and he says I barely scratched her bumper so must have barely touched her and she must have been right behind the RV to have had the damage that was done. The front of her car essentially went under the RV, destroying the hood. Don't know what other damage it did but the car wouldnt' run. Although my insurance didn't go up as much as I thought it would, so maybe it ended up not being as bad as it looked. But I was young.

Ah, cheers. Will do.

Does a speeding ticket (no penalty, just a fine, no disqualification from driving) count as an offence? I did get one speeding ticket in 2007 which I paid off. It had no effect on my licence. The online application says "disqualification due to speeding" as an example, so unsure if this counts.

I know...I don't know what they mean by "disqualification due to speeding." I would interpret this as a suspension, but not all speeding tickets result in a suspension (same here in the UK). So its just confusing. It does count as an offense though, and should be listed on applications. What is the most confusing on the old applications is that it asks if you have ever had any convictions, but they include speeding tickets into this category (at least on the application). It generally has no affect on the decision, but you should be forthcoming as it shows honestly and, if they DID do a really deep background search on you and found you did not disclose it, they would take it as you trying to hide something.

I actually reviewed my first application which I saved and did not list it there, and recalled that on this forum a speeding ticket was deemed not a conviction or offense.

Hopefully someone (paging ksands?) can come in and clarify, however.

Strange, I was given the opposite advice in 2014. And any other advice I've seen on here on the subject was the same as given to me. But, if FLR changed like ILR, it says to only list if you have 3 or more. So it may not even matter for you???

This application seemed to ask for a bit more details because one of the questions specifically asked for cautions or warnings,  hence why I listed my warning. I would put everything you remember just in case. Minor offences aren't going to be an issue.
