New to the spouse visa process - a lot of questions
« on: July 09, 2020, 10:38:05 PM »
Hi everyone,

I am new here so bare with me as I navigate this whole new forum (I am used to 'visa journey' lol)! I am a UK citizen married to a US citizen and I immigrated to the USA with my 2 year conditional green card in October 2018 where I will have to remove my conditions in order to get my 10 year one in October this year. Before we started the immigration process, we were only planning on staying here for a few years due to my husband wanting to stay in the current job he had, then fully immigrating to the UK where we will live the rest of our lives per se.

I have a lot of questions regarding this.

Our lease is up December so i was wondering if we were able to immigrate together around then. Of course because of covid-19 I have been furloughed and instead of the furlough system they have in the UK, the USA has a system where you claim unemployment money. Does this mean that this doesn't count as my income? I think I read somewhere about counting the 6 months before march 1st 2020 as your income (as I am a hourly employee, and in which case puts me over the £18,600). Also obviously doing this I would need a job within the 3 months from arriving in the UK? I am assuming then my husband and I would spend roughly up to 3 months apart?

So there is one option, another option is that I just leave to the UK where I find the correct job. Just want to clarify can he apply for the spouse visa after me working 3 months if its a salaried job? or is it 6 months then he'll apply for the spouse visa which will then take an extra 3 months? I would prefer not to be apart from my husband for this long but if that has to happen it does lol! Or is there a way for him to come with me for a part of it and possibly not work and then leave and re-enter the country when the spouse visa is ready?

Do you think its better to wait til covid-19 is all over to start this process? Especially with the backlog of applications?

Also, with my green card, I do understand that I'll need to pay for the one in October even though I'm thinking about leaving in Dec.
I've read that if I want to abandon it I would have to fill out a form. For me to visit the US to visit my husband while he waits for his spouse visa or in the future to see his family, would applying for the VWP/esta be an issue?
OR I've seen an application for a re-rentry permit, have people done this and is this a sensible option? (i understand about paying tax in both countries, I just want to get all my options). How long does this last for? Does it only work for 2 years with the one time entry, or does it carry over past the 2 years?
