Visa for a family member outside of my household?
« on: July 03, 2020, 04:44:33 PM »
So I’m looking to get a family member here with me for safety reasons (I won’t go into too much detail here. Please send a pm if more info is needed to help) but I’m in the process of getting my flr(m) right now and I don’t know what said family member would need to stay long term (not mine or my husbands child). I’ve already submitted my application so I don’t know what to do or if the child would even need a visa given the situation. I can’t really afford a last minute solicitor and need all the help I can get as quickly as possible.

If it’s a minor, you would have to adopt the child and then bring them to the UK.  If an adult, there are no options.

I’m sorry it’s not better news but better to know the truth than throw thousands at an attorney.  If adoption is an option, you’ll need to find a long term residence where the child can safely reside while all the paperwork is being processed.  A previous member took two or three years to do it.  But it all worked in the end!

The child is a minor, will most likely be taken into CPS custody and there is no one back home who can take him in. I can get custody, so even that, I’d still need to adopt to get him here for a long stay?

Yes, you would need parental responsibility to bring the child to the UK.  There is no way around it and it's not fast, I'm afraid.  There are only two options.

1.  Move to the USA and parent from there while the adoption process is happening.  Move back to the UK after the adoption process is complete.

2.  Find some way to get the child into a secrure, loving home while the adoption takes places while you are still in the UK.

And unfortunately this will require a lot of legal advice and is not going to be cheap.  But I'm so glad that the child has someone who loves him/her enough to do this.

Our other member who did this, did it for her nephew.  I was overjoyed when after a few years they were finally able to start life together.  :D
