If varying the application is tricky, then I guess I could wait for for the decision for my FLR(M) and then apply for my ILR.

I think varying is ok (if you can at that stage) and it is withdrawing and then applying again, that is the problem with 3c, but please check this with somebody who knows and who has done all this before, many times.

Wow that's insane.. I think my old visa was finishing 17th of April but I submitted it on the 3rd of April... That does make any difference?

No, that is fine as you needed to put in a valid, in time application for 3c to engage. It's the rest we don't know.

It's using the new rules in the correct way. A good immigration solictor will know how to do this.
