Visa expires before Bio appt., do I need to do anything?
« on: July 15, 2020, 08:50:26 PM »
Very simple question that I am sure has come up a million times already...

I submitted my ILR application end of June, my FLR(M) visa expires August 9th. Due to the way UKVCAS is allowing appointments to be booked, I know I will not be able to get a bio appointment before then (only people who have applied on or before May 31 can book at the moment). Do I need to email the home office or take any further steps, or is the very fact my application is submitted before my visa expiry enough at the moment?

Thank you all!

As long as you submitted an on time, valid application, your status is protected under section 3 c of the immigration act. No need to do anything.

Also, if your employer wants to check that you still have the right to work while you are waiting for your biometrics appointment and visa to be processed, that can be done here:

Hi Ksand24,

Thanks for posting that site, I had no prior idea of its existence.
My application was submitted on 30 June and I’ve now checked my status, which only shows my right to work up until my visa expiration date and no reference to my application being processed.

Any idea what might be the case or what I should do to ensure that everything is ok?

It's up to your employer to do the checks, not you,. They need to go to this link (which you can get to from this page):
https://www.gov.uk/employee-immigration-employment-status

When they go through the checklist, there is an option for them to tick that you have a pending application for FLR with UKVI. They then need to enter the reference number or case ID of your FLR(M) application and it will tell them whether you still have the right to work while the visa is processing.

You can also show them the 3C Leave guidance which explicitly states that as long as your application was submitted before your visa expired, your right to live and work in the UK is automatically extended:
