Hi All,

I know it’s early but were trying to look into a few travel plans (As I am aware one cannot travel during a pending application/submission) and I want to make sure I have my dates in order for the ILR application in the foreseeable future...

My understanding is that the general rule of thumb is that one can usually apply for ILR within the 28 day period preceding the point that one's visa expires (BRP), or within 28 days before the completion of your residential period from the date you entered the UK, whichever is sooner.

In our case, BRP expiry is the 22/04/2023
My wife initially entered the UK on 08/11/2017 (based on the vignette stamp)
Therefore the earliest we can apply is 28 days prior to 08/11/2022 which in our case would be anytime from the 11/10/2022 up until the BRP expiry of 22/04/2023.

Correct?


Initial Spousal Visa (US Citizen)

Date of online Application: 24th June 2017
Date of Biometrics appointment/submission USCIS centre, New York: July 7th 2017
Decision Email: October 7th 2017
Passport returned with approved Visa/Vignette: October 11th 2017.
Arrival into the UK from US: 8th November 2017 (Stamped date on vignette sticker on arrival)
BRP expiry date: 27th June 2020

FLR(M)

Type of Application: FLR (M) for US citizen
Date of online submission: June 12th 2020
Date of invite to IDV App: August 3rd 2020
Date of OptOut of IDV App: August 6th 2020
Date of Appointment booking invite email for biometrics: August 13th 2020.
Date of biometrics appointment with document scanning (paid): September 5th 2020, CROYDON, LONDON.
Date of Approval Email: September 25th 2020
Date of BRP delivery via post: September 30th 2020

ILR...
Type of Application: FLR M
Country applying from: UK, London
Nationality: US Citizen
Online application: 12th June 2020
Sopra Steria Doc Upload: TBC
Biometrics: Awaiting to book appointment
FLR M Received/New BRP: Awaiting

This is the date which matters. You can apply from 28 days before the 5 year anniversary of the date of entry to the UK, up until the expiration date of the BRP.

It's not a rule of thumb, it's just the actual rules.

You can apply for ILR up to 28 days before you reach the end of your 5-year period. Depending on the visa type you entered the UK on, this may either be the 5-year anniversary of your entry to the UK (if you entered on a spousal visa), or the expiry date of your current FLR(M) visa (if you entered on a fiance visa or a work/student visa and then married in the UK and switched to FLR).

Yes, the earliest you can apply is 28 days before 08/11/22... which will be 11th October 2022, and you have until 22/04/23 to apply.

You know, you can just put your timeline in your signature instead of adding it to every message you post :).

You might just have to condense it down a bit though as the signature box only allows 550 characters

I did put it on my signature (via the taptalk app!) so I think it’s coming up as part of the message as opposed to an actual signature.

Removed it now :-)

I guess I need to just add it to an actual signature by logging into the UK Yankee site online right?
