New application for ILR! URGENT

Hello, I need a much help as I can get as far as advise. Due to personal reasons I disregarded how fast my currentl spousal flr m it’s expiring.
So I have completed my 5 years route through spousal visa and it will expire on 10/12/2020

I have started the online application now but can someone please tell me if the life in the U.K. test has to be done prior to submitting the application? Or how does it work.

I know I have slacked on getting prepared but any help it’s greatly appreciated!

I won’t be needing the English test as I am an American citizen so I checked and I can bypass that test.  So please any idea of what documents will be needed for me to send? Thank you so much!

Yes, you must have passed the Life in the UK test before you apply, because having passed the test is one of the requirements for ILR (it is also a requirement for UK citizenship). The Life in the UK test pass certificate never expires, so you could have taken it at any time in the last 5 years.

Best thing to do is to book a test ASAP and hope you can study for and pass it before 10th December:

If you cannot pass the Life in the UK test before applying for ILR, you will be granted another FLR(M) instead, and will have to apply for ILR again once you have passed it.

Having said that, if you can't pass it before 10th December, if you book your biometrics appointment for a few weeks out, you may have enough time be able to pass it between applying online and attending biometrics/submitting your documents.

The documents you need to include are basically the same as you the documents for FLR(M), plus the Life in the UK test reference number:
- financial requirement documents
- accommodation documents
- marriage certificate plus 6 items of correspondence in each name, spread evenly over the last 2.5 years (1 in each name every 5 months)

Thank you so much! For all the information I have booked the life in the U.K. test successfully before my visa expires. I never knew the test was a requirement for the ILR only knew it was for the citizenship.

Now do I book my biometrics how or when? Is that after I submitted my online application having paid the application fee iof around £2900?

Yes, you apply online first, then you register an account with UKVCAS, through a registration code that they will send you by email. The ILR application fee is £2,389.

Once you have registered with UKVCAS, you can book a biometrics appointment on the UKVCAS website.

Then you have until your biometrics appointment to upload your documents... or you can purchase the scanning service when you book biometrics for about £50, and they will scan and upload the documents for you at the appointment.

Do I have to pay an NHS surcharge with this application?

No, there is no IHS for ILR. Good luck with your test.

The order of doing things is:

- Take the Life in the UK test on December 4th
- Submit the online application and pay for the visa by December 10th
- Register an account with the UKVCAS website (you should receive a registration code by email after you have submitted the online application)
- Book a biometrics appointment on the UKVCAS website... appointments tend to book up quickly, particularly the free appointments, so it may take a few days/couple of weeks to be able to find an appointment
- Before attending your biometrics appointment, upload all your documents to the UKVCAS website... or if you want, you can purchase the Document Scanning service for £50 when you book biometrics and have them scan all the documents for you at the appointment
- Attend your biometrics appointment
- Wait for the visa to be processed and your BRP to be mailed to you

However I am confused about something, if all the supporting documents are meant to be uploaded to UKVACS, what about the request for my passport and brp ? Do I have to post that still to them? Congratulations!  :)
Passport and BRP are scanned and uploaded with the rest of your documents.

The only thing that matters is that you have submitted the online application before December 10th.

After that, it doesn’t matter what date you attend biometrics or how long it takes to get the visa... your immigration status will simply be extended under Section 3C Leave while your application is processing.

So, just book your biometrics appointment for the most convenient date in January.
