Topic: Time for ILR application so I have a few questions please and many thanks in adv  (Read 1265 times)

He arrived in UK on 3/2/17 so assume we can send this off 28 days before 3/2/22?

We are using form FLR(M) - assume this is the correct one?

"Do you have any children whose parent is not your partner?" - does that only refer to children under age of 18 - we both have adult children in their 30s and 40s but we wouldn't class them as children so have said no - is this correct?

"Do you own or rent your home?" - does he put "Neither own nor rent" if he lives with me but isnt named on the mortgage (He didnt have a job when we got the mortgage so the house is in my name only) (if so, would I need to provide letter stating that he lives with me?)

  • Husband (Applicant) US passport
    Husband (Applicant) BRP
    Husband (Applicant) NI Letter
    Husband (Applicant) Life in UK Test pass letter
    Relationship declarations
    Marriage Certificate
    Husband (Applicant) 2xDivorce Certificates
    Wife 1x divorce certificate
    Wife UK birth Certificate
    Wife UKPassport
    Wife (sponsor) - job contract
    Wife - employment letter
    7 months payslips
    Last 2 year's P60
    original Bank Statements showing corresponding 7 months salary
    Land Registry document for our current address
    6 letters and/or other documents addressed to you and your partner at the same address to show that you have been living together during the past 2.5 years(Or equivalent for each) - spread 3 months apart

AM I missing anything?

That's correct.

No, that's the wrong form. FLR(M) is for a 2.5-year temporary extension visa, not ILR.

The form you need for ILR is SET(M):

That's correct - only children under 18 need to be included (because if the visa falls for refusal, they look at whether you have any UK citizen dependent children under 18 whose lives would be badly affected if you had to leave the UK).

Not correct. They are asking 'you' as a couple, not the applicant as an individual. The correct answer is 'I own' because as the sponsor, you own the home you both live in.

The options mean:

'I rent' = you as a couple rent your home from a landlord. Neither of you owns the house.

'I own' = either the applicant or the sponsor (or both jointly) own the home you live in. It is not rented and it does not belong to anyone else.

' I neither rent nor own' = you as a couple do not rent or own the home you live in. Instead you live in someone else's house which they own, for example, a family member or a friend (i.e. you live with your parents), and you are basically just a guest in their house.

In regards to the documents, you do not need the following, so you can take them out:
- Husband (Applicant) NI Letter (not sure why you are including this)
- Relationship declarations  (not sure what these are)
- Wife UK birth Certificate (not required for any visa unless you do not have a valid passport)
- Husband (Applicant) Life in UK Test pass letter (unless the test was taken before December 2019 these are not issued anymore - instead you are given a reference number that you enter into the application form)
- Last 2 years' P60... you only need the most recent one from May 2021... and even that is only optional

The documents you do need, arranged in upload sections are:

Application Documents
- Husband (Applicant) US passport
- Signed sponsor's declaration confirming information provided is correct and true (part of online form)
- Part 1 Consent to Checks form signed by applicant  (part of online form)
- Part 2 Consent to Checks form signed by sponsor (part of online form)


Proof of Identity/Travel History
- Applicant's BRP card
- Wife UK Passport

Finances
- Wife - employment letter
- 7 months payslips
- original Bank Statements showing corresponding 7 months salary
Optional but recommended:
- May 2021 P60
- Wife (sponsor) - job contract

Residence in the UK
Accommodation
Evidence of homeownership
- Land Registry document for our current address
Evidence of monthly housing costs
- latest annual mortgage statement
- latest council tax statement

Cohabitation
6 letters and/or other documents addressed to you and your partner at the same address to show that you have been living together during the past 2.5 years(Or equivalent for each) - these must be dated every 5 months and be from at least 3 official sources
If applying in January 2022, you will need 1 document in each name from each of the following months:
July 2019
December 2019
May 2020
October 2020
March 2021
August 2021
January 2022

Other
Marriage Certificate
Husband (Applicant) 2xDivorce Certificates
Wife 1x divorce certificate
