Topic: FLR (M) - question about husband's 18-year-old daughter who is a British citizen  (Read 1942 times)

Hello all,

I've started my application and run into a bit of a snag. My husband has an 18-year-old daughter who is a British citizen whose mother has sole custody and we see her every other weekend and other days here and there. Now, she's technically an adult (she's 18 and a graduate) but the application is still making me include her. They want me to provide the following information:
Please provide details about this child's parent. Include the other parent's name, address and their level of contact or parental responsibility.
Evidence of where her other parent lives - such as utility bills.
Her birth certificate

Has anybody else had this situation? I'm assuming I have no choice but to get this information but just wanted to make sure there wasn't a way around it? I think it's incredibly invasive to ask her mother for a copy of her utility bills and, honestly, she's an absolute nightmare to deal with so I don't see this going down well. We didn't have to provide any of this information the first time around so I'm praying there's a way out of it.

Also, my BRP was issued on 13-12-2018 but I came into the country on 01-01-2019. I'm on the ILR route so I'm waiting as long as possible to apply so was planning to apply 28 days out from the expiration date of 19-09-21. That's my best bet, yes? I shouldn't apply sooner?

Why is the application making you include her?

As she is over 18 she doesn’t need to be included on the form, so you can just tick NO when it asks if you/your sponsor have any children living in the U.K, and you won’t even have to mention her or provide any documents for her.

You can apply up to 28 days before you reach 30 months in the UK, so if you entered on 1st January 2019, you reached 30 months in the U.K. on 1st July 2021... which means you have been eligible to apply since 3rd June 2021.

So, you can apply at any time between today and 19th September :).

Well, this was the question asked of me:
Do you have any children of 18 years old or under?

Then the next question was:
Does (spouse's name) have any other children in the UK that are not applying on this application?

So I said yes because 18 was the included age for me and he does have an 18-year-old daughter.

It's a real conundrum for me!!

Ah, okay. I thought it was just children under 18, not 18 and under.

In that case, you will need to answer the questions about her and include the following documents:
- her birth certificate
- her passport
- a letter dated in the last 3 months confirming her address (I.e. from her school or GP)
- evidence of where her mother lives (I.e. a utility bill or similar)

The reason they ask about children is that if your visa was to fall for refusal, they will look to see if you qualify to be put on the 10-year route to ILR under Article 8, and one thing they look at is if you have any British citizen children living in the UK whose lives would be seriously disrupted if you had to leave the U.K. (either with or without them).
