Naturalisation/ Break up
« on: March 15, 2022, 11:37:36 AM »
HI there,

Quick question. So I currently hold ILR and just applied for my Citizenship in the UK. (I waited 12 months after receiving ILR).

I am married to a British citizen however the relationship has been rocky and I've decided to take time apart ie live at different addresses. When I was applying for my Naturalisation, I had to state my relationship status.

Therefore when I filled in my application I had to provide relevant documents ie marriage certificate and my husbands passport.

I can apply independently not relying on being married as I've waited 12 months after receiving ILR and can prove I've lived in the UK for over 5 years (which they will be able to check in my passport).  But will my application be delayed if we decide to file for divorce while waiting for the outcome of my application?

Will Home Office accept the application as an independent one regardless of my marital status?

Some advise would be much appreciated.

You'll be fine either way.  You qualify for citizenship regardless of your marital status.  As you've already applied, they'll use the marriage certificate (as you are, in fact, still married).

Big hugs.  Divorce sucks.  Hopefully you guys can work things out (if not a toxic/abusive relationship).

Thanks lovely. It will be okay xx

And thanks so much for letting me know. I was just thinking if it does come to it, hopefully it won't prolong the processing time as it is already extended due to Covid etc
