ILR (M) question about my child
« on: May 03, 2023, 09:01:51 AM »
Hi there,

I'm currently applying for my ILR as a partner of a British citizen. Since my last renewal, we had a baby who was born in the UK and has dual US/UK citizenship. Do I need to include him on my application at all? There doesn't seem to be a space to do so other than adding another applicant, but surely since he's already a citizen by birth I wouldn't add him there.

Any insights would be greatly appreciated! Thanks so much.

You are correct in that children who are British Citizens do not need to be included on the application.

We did mention our son when we did ours recently in the "do you have any other reasons for wanting to remain in the UK" as, obviously, a refusal would be detrimental to his wellbeing.
