FLR(M) renewal

Hi all -

As we're quickly approaching the time for us to obtain the renewal of my husband's FLR(M) visa I thought I'd ask a couple questions to clarify anything to make sure we're covered - thank you in advance for any help!

My understanding is we can apply as early as 28 days before 30 months after his arrival to the UK:
He arrived 22/11/2020, date on BRP issue is 04/03/2021 and expiry is 25/08/2023 - so would we be able to apply any time from late April as May is 30 months from November 2020 correct?

Regarding the number of cohabitation documents we have - we have Gas&Electric bills (monthly) and council tax (yearly) in both our names and then phone, bank statements etc individually throughout the 2.5 years - how many of these is ideal to upload/use? How many per person, per year?

Regarding a tenancy agreement - we've lived in the same apartment since March 2021 - however this year we've not yet renewed for a full year and just come to an agreement with our landlord to extend (currently until July 2023) due to the need for roof works later this year that could mean we need to vacate. Is our original agreement valid as the other documents with our address/names on prove we still live here together or do we need an updated signed agreement for the year?

And lastly - am I correct in saying that we cannot apply/submit the application if we intend to leave the UK at any point after we submit but before approval? We're due to go to Germany in May for a few days so will wait until after that to submit anything on the off chance but wanted clarity on that.

Just bumping my previous post as I haven't heard back - mostly for help on this part of my enquiry as we still don't have clarity post-July from our landlord so I am concerned as to what we actually need in order to properly demonstrate our cohabitation going forward?

Did he first enter as a fiancé? If so, you start counting the 30 months from when his FLR(M) started, not from when he entered the UK, as time before that doesn't count toward ILR. You'll want to apply 28 days before his current visa expires.

Also, you refer to the ILR but wouldn't this application be for an additional 30 months of FLR(M) as a renewal and then after that we'd apply for ILR? or am I mistaken?

That's correct.

As he entered on a fiance visa, his 5-year count to ILR didn't start until the date his current FLR(M) BRP started... whereas if he had entered on a spousal visa, his 5-year count would have started on the day he landed in the UK.

Yes, that's correct - he needs to spend 5 years on two FLR(M) visas before applying for ILR.

What cityplanner meant though, was that the date that his 5-year qualifying period began was the start date of his current FLR(M), and so the time he spent on the fiance visa before that doesn't count towards those 5 years.

Regarding the tenancy agreement issue then (I'd hope we would have a definitive by the time we apply if we can't until the end of July but just for peace of mind..):

How would this work if we can only apply in late July? Do we need a new full signed agreement or would a statement from the landlord stating the new terms (if we agree an additional 3 or 6 months until the roof works for instance) be enough? What happens if we do need to vacate in July or shortly after? How do we go about proving our place of residence/cohabitation while in the middle of a move ?
