ILR Queries
« on: August 06, 2023, 03:11:04 PM »
Hi all,

Just in the process of preparing my ILR application and had a quick question. Say my target date of submission is 15 August 2023. How would this impact the 28-day rule in terms of payslips and bank statements? My partner's last payslip has two dates: a pay date of 26 July 2023 and a period end date of 31 July 2023. If I submit the application on 15 August, would this payslip and corresponding bank statement meet the requirements?

Many thanks!

To be on the safe side, I would base your 28-day calculation on the pay date of 26th July rather than 31st July.

So, if you use 26th July, then you have until 23rd August to submit your online application (28 days after 26th July)... so you will be fine to submit on 15th August.

Thanks ksand.

I saw on a previous thread that super priority slots are released every morning at 1am. What about the other priority (5-day) service? Are these slots released at the same time or is this service not offered anymore?

Also, we bought our house almost 12 months ago, but given the delays with land registry our title register still hasn’t been registered. Would a mortgage statement and mortgage agreement suffice to prove ownership for the purposes of ILR?

Thank you!

There is no 5-day priority service available for ILR applications (it only applies to certain application types).

Your only options are the standard processing (£0 extra) or the 24-hour Super Priority service for £800.

For the accommodation requirement, you need to provide:

Proof of homeownership:
- usually the Land Registry document

Proof of monthly housing costs:
- latest mortgage statement
- latest council tax bill

If you don’t have the Land Registry yet, I would explain that in a cover letter and provide any other document(s) you have that prove the house sale officially went through.

Thank you. We have completion letters signed by both party's solicitors and SDLT receipts. Hopefully, this and the letter explaining the lack of Land Registry will suffice.

I've also just noticed on the online application that the Home Office will accept original documents as well as copies (except for the Passport). I always thought you needed originals. Is this a recent change? I ask because we are missing a few bank statements showing salary deposits - it would save us a lot of time to download the statements rather than request originals.

Just one more quick question before I forget :) - My partner's pay range ranges from 26 January 2023 - 26 July 2023. By my calculation, this is bang on 6 months. Would this suffice or is it overkill to also include December 2022?
