Jobs with a view to ILR next year

Hi everyone :)

Hope everyone is doing ok!

I'm in a bit of a pickle.

Tre has started a small business, so I am the permanently-employed one for ILR purposes.  Tre is looking to support the business with a part-time role but yet to find something suitable.  I'm full time but not enjoying my work as the role seems to have changed.  I undertook a professional qualification but part of the terms for that are needing to stay with the firm for a year after completion or repay the cost.  It was a three-module course that took a while to study in my own time and during that period I've come to enjoy the work progressively less.  To leave asap with minimal repayment due, I'll need to stick it out until June next year.  However, as ILR is due on 3 October give or take, I wonder whether starting a new role in June would be a mistake as I would struggle for 7 months of payslips in my new role within the ILR application window.

So I was wondering how this will be viewed, if the income threshold is mostly from a curent role but a couple of months from a previous role?

If you will be changing employers next year and will not have been with your new employer for 6 months yet by the time you apply for ILR, you will need to meet the financial requirement under Category B instead of Category A.

Category B has 2 requirements:

1) you have been with your current employer, earning at least £18,600, for less than 6 months
AND
2) you have earned at least £18,600 in total before tax from any and all jobs held in the last 12 months

You will need to provide:
- 12 full months of payslips (from both current and previous jobs)
- 12 full months of bank statements showing the deposit of all the payslips
- letter from current employer confirming employment details and verifying payslips if required
- if your previous job payslips were issued electronically, you also need a letter from the previous employer verifying the payslips

Optional but recommended:
- job contract from the new job
- May 2024 P60

So it's doable but a bit more of a faff, ie double the payslips and statements.

The only potential stumbling block is if HR at the previous employer (so my current employer as of now) are not willing to provide the verification letter for an employee who left a few months previously.  How big an issue could that be?

Has anyone had the experience of changing roles within 6 months of ILR and not being able to get the HR letter from a previous employer?

Would the role I'm in at ILR need to be permanent or will they accept fixed term contracts?

You wouldn’t need a letter from previous employer. Just prior payslips and bank statements.

Than you KFdancer - that's a help.

I've been offered an interview for a role that would be a 12 month fixed term contract - what's the gov.uk view on this?

I could imagine it would be problematic as potentially my term would be ended around the same time as ILR is due... I guess if there would be an opportunity to make the role permanent during the fixed term I could consider it?

What's the lay of the land re fixed term contracts?

You wouldn’t need a letter from previous employer. Just prior payslips and bank statements.

While you don't need a letter from the previous employer confirming employment details, if the payslips from that job were issued electronically, they should be accompanied by a letter from the employer confirming their authenticity.

From Appendix FM-SE (https://www.gov.uk/guidance/immigration-rules/immigration-rules-appendix-fm-se-family-members-specified-evidence):

Quote
(bb) Payslips must be:
(i) formal payslips issued by the employer and showing the employer’s name;
OR
(ii) accompanied by a letter from the employer, on the employer’s headed paper and signed by a senior official, confirming the payslips are authentic;

Hi everyone, hope everyone's having a great weekend :)

I've been told that there wouldn't be a chance for the role to go permanent before the end of the fixed term, so I'd be coming to the end of my fixed term contract pretty much at the time we'd be applying for ILR.

I feel like this would jeopardise our application, but would appreciate any input from anyone who knows for definite or has experience of submitted for ILR when on a fixed term contract.
