Getting ready for ILR application

My residence permit is expiring 02/10/2023. I’ve been doing some reading about how to get everything ready but have a few things I’m confused about:

I read that I can start the application 28 days before the 5th anniversary of the day I first landed. I landed July 20th, so  do I have to start before then? Or do I have until my residence permit expires?

Also, at the moment I’m unemployed and looking for a job. So I won’t have a payslip for June since I wasn’t working, will that be a problem?

You have until your residence permit expires to submit your application.

The 28 days before 5 years since you arrived is the EARLIEST possible date you can apply online.

So, if you arrived on July 20th 2018, you can submit the online application on any date between:

22nd June 2023 and 2nd October 2023

How will you be meeting the financial requirement for the visa?

If your spouse can meet the £18,600 requirement using his income, then you only need to provide his payslips and bank statements and not yours, so it won’t matter if you have a June payslip or not.

My spouse makes over £18,600 but he has only started this job in April.

He was made redundant in January and didn’t find a job until April. I was employed until June due to leaving for personal reasons.
My previous job plaid more than £18,600 as well but since I left and haven’t found a new job yet I don’t have a payslip for June and now possibly July.

Does it have to be payslips from one spouse or can it be a mixture of both?

Okay, so you will need to apply under Category B, but unless you manage to get a job before you apply, you will have no choice to use your husband's current employment to meet the requirements.

For Category B, you need to meet the following 2 requirements:

- You are currently employed in a job paying more than £18,600, but you have not yet been at that job for 6 months (this will be your husband's income, unless you manage to secure a job paying at least £18,600 before you apply)
AND
- you and/or your spouse have earned at least £18,600 in total before tax in the last 12 months, from any and all jobs either of you have held in that time (you can combine your earnings from the last 12 months to meet this part)

And the documents you will need to provide are:
- 12 full months of your husband's payslips (either just your husband's if he has earned more than £18,600, or both yours and your husband's if you need to combine them) showing at least £18,600 before tax in total
- 12 full months of your husband's bank statements showing the deposit of every payslip
- 12 full months of your bank statements showing the deposit of every payslip (if you will be including your payslips too)
- husband's current job contract
- husband's latest P60
- letter from husband's employer stating all his employment details, and verifying all his payslips if they were issued electronically
- if your payslips were issued electronically, a letter from your previous employer verifying each payslip you are submitting

Under Category B, it doesn't matter if you don't have a payslip for June, because as long as you meet the total earnings requirement, it doesn't matter if you were unemployed for part of the year... and of course,  it is not physically possible to provide a payslip for a job you didn't have.

I have a job now and it makes more than £18,600!

Congratulations :D!

A P60 is not a required document for the application, so if you don't have one, then you just don't include it. No big deal.

The mandatory financial documents are:
- payslips
- bank statements
- employer letter

The optional financial documents are:
- job contract
- P60


If you have your job contracts, I would include them, but it won't be an issue if you don't have any P60s to include.

So I’ll be applying this month, and just want to make sure I have everything in order before I do.

Do the bank statements have to be mailed or can they be printed?

If my husband and I have had different employers throughout the year, do we have to provide those contracts as well? Or just the employee contract I’m at currently?

Both our payslips are electronically, so we will get a letter from our employer. Does the letter have to state each date for the payslips or can they just say the payslips from this date to that date is authentic?

Does anyone know who does the employer addresses the letter of payslip authenticity to?

I remember with other letters for my spouse visa they would be addressed to Vulcan House. Would these letters need to be addressed to Vulcan House as well?

We just addressed ours as "To Whom it may concern"

Does anyone know who does the employer addresses the letter of payslip authenticity to?

I remember with other letters for my spouse visa they would be addressed to Vulcan House. Would these letters need to be addressed to Vulcan House as well?

11 months bank statements - waiting for September bank statement
11 months payslips from both of us - waiting for September payslips
Letters from employers authorizing printed payslips.

Council tax letter (both names)
This letter I have as evidence is addressed to our previous address that we lived in, Would this be an issue?

Waiting for mail..

A few questions I have just to clarify things:

My bank statements usually come mid month, but my husband and I don’t get paid until the end of the month, so this month’s bank statement won’t be show when we get paid for September. I can’t wait until next month because I have to apply by October 2nd. Any advice?

Also my husband has his payslips from his previous employer but can’t get a letter to authorize them because the company no longer exists. Should we write a letter explaining the situation?
