Have I royally screwed up my ILR?
« on: October 12, 2023, 12:49:27 PM »
Hi everyone, thanks for all your help over my last couple visas. I've submitted and paid for my ILR application today but haven't gotten a biometrics appointment booked yet. My BRP expires tomorrow (13-10-2023), am I right in thinking as long as I've submitted my application and paid the £2885, it's okay that my biometrics appointment would be a week from now?

A variety of reasons has pushed back me being able to apply for ILR, I've been trying to get it done for the last couple months but the dates didn't match up for evidence needed on payslips, etc.

Have I royally messed up or is it okay that the biometrics is slightly after my BRP expires? If its okay to wait, how long is the maximum allowed as I want to get it done but I also wouldn't mind trying to get a free appointment.

Don't worry! You are fine. As long as you submitted and paid for your application before the BRP expires, your current status is protected under section 3C of the immigration act.

Good luck finding a free appointment. It may help if you look at centres a bit further away.

Valid applications prevent the applicant from being an overstayer under 3C of the Immigration Act 1971 while Immigration staff decide, as larrabee has said.

This is the Immigration Staff Guidance for 3C and 3D leave "Last updated 17 August 2023"
