Increase to the Immigration Health Charge
« on: October 25, 2023, 03:57:02 PM »
As expected, this seems to be the Draft Statutory Instruments to raise the annual cost of the Immigration Health Charge?

1.(2) This Order comes into force on the later of 16th January 2024 or the twenty-first day after the day on which it is made.

It appears that this was debated in the Public Accounts Committee this past Wednesday, but not yet approved:

Last Wednesday it was approved without dissent by the Delegated Legislation Committee.

The House of Lords had already approved the rise last month.

This week the House of Commons will approve.

Although this was made a Draft Statutory Instrument months ago, the delay in the start date (unable to be signed and made a Statutory Instrument) has been due to the State Opening; parliament business has to shut down and restart.

Some on here recommend Laura Devine and on their website it states-

The increase was set to come into force on 16 January 2024, however, it is scheduled to be debated in the House of Commons on 10 January 2024 and the increase may only be implemented 21 days after it becomes law. The IHS increase should, therefore, take effect from 31 January 2024.

Thank you for the clarification.

So if I understand correctly, the 21-day clock starts on the day that the House of Commons gives approval? For example, if approval is granted on Monday the 15th, then the date it will take effect will be Monday the 5th of February. Do I have that right?

You can see that it was approved (without dissent) in your link.

In conclusion, our NHS was founded to care for every citizen in their time of need. We as a Government, and, I think, all Members of this House, feel that that principle must be cherished and preserved. Equally, it is right that migrants granted temporary permission to be in the UK make a financial contribution to the running of NHS services available to them during their stay—that is a matter of fairness. On that basis, I commend the order to the Committee.

Question put and agreed to.

I also thought it would be approved (made) when  the Commons voted as the Lords have already agreed to the rise on 18 December, until I read the immigration lawyers site (link above).  What happened last Wednesday (10th) in the Commons, was the link you gave above.

I assume we will find out the start date for the higher IHS contribution, this week. It's 21 days after the order is made, whenever "made" is.
