ILR Decision Wait Times ??
« on: January 15, 2024, 07:48:35 PM »
Hey all, has anyone submitted their ILR application in the last few months? Just wondering if anyone has received a decision and how long it took. We submitted 15th November, and assume it will be a bit more than the 8 week wait time listed on the government website because of the holidays.

Surprisingly I've been able to forget about it for the last two months, but now we are getting anxious!!

 :)

ILR (SET(M) form) has a processing standards time of 6 months (the 8 weeks processing standards time is for FLR).

See here:
https://www.gov.uk/government/publications/settlement-customer-service-standards/settlement-customer-service-standards

So if you submitted 15th Nov 2023, your application should be processed by 15th May 2024. However, we have seen some pretty quick ILR applications processed recently (1-2 months), so you may well get yours sooner than 6 months.

Oh gosh, I totally got that wrong didn't I?!  :o ::)

Thanks so much, let's hope it happens quickly.

Am I allowed to travel outside the UK while I'm waiting for a response? My BRP expires at the end of January :-/

Unfortunately not.

As long as you remain in the UK, your immigration status will be automatically extended under Section 3C Leave while your visa is processing, even if the BRP expires in that time

However, as soon as you leave the UK, your ILR application will be invalidated, and your Section 3C Leave will cease - which means that if your BRP expired while you are abroad, you would not be able to return to the UK again, as you would no longer have a valid visa and no immigration status protection… therefore you would have to start the entire 5-year spousal visa process over again from your home country in order to move back to the UK.

Thank you ksand, you are always so helpful - you helped us loads 5 years ago when our visa application was rejected (due to a solicitor error!). I'm really grateful!
