Is a "Incapacity Benefit" considered public funds?

Hello,

Just wanted to know if 'Incapacity Benefit' is a benefit that immigration takes into consideration?

My husband (Brit) is receiving this benefit for epilepcy.  I've looked on the visa4uk website and it lists all benefits considered, but this is not listed, though it does list 'disability' and 'severe disability' as benefits that they must consider. 

Incapacity just sounds like it's very close to one of these benefits just with a different name.  Any clarification would be very appreciated!

Incapacity Benefit is for people who can’t work because of an illness or disability, so I would think that it would count.

Happy to be proven wrong by one of our resident experts, of course.

Mr Nibbles:  I just wanted to say that the sunflower countdown in your sig gave me a good giggle!  TA for that.

About this incapacity and disability business, volume, the form wants to know if the sponsor is receiving public funds, yes or no.   And your sponsor is on incapacity benefit for epilepsy.  So the answer would be yes because that falls under SSC&B/1992; and HC395 says that anything that falls under SSC&B/1992 is public funds.   Including any medication he may receive.  It's in the instructions.

It absolutely does not mean that *YOU* would have recourse to public funds, however.   And it does not mean your app will be refused.  It just means that they need to know about it in order to have the big picture on your circumstances.
