I-130/G-325A Address Question
« on: April 03, 2005, 03:04:37 PM »
I-130/G-325A Address Question:

I  (a U.S. citizen) am in the process of filling out the forms I-130 and G-325A  and plan to file within a week. However, I have run into a  problem. I asked if we could file with the London Embassy but they told us we have to file with Vermont service center due the fact that I did not reside in the UK long enough.  Fair enough, but due to the long visa process I plan to stay with my wife in the UK for a few more months while the process is being started.  I then plan to go back to the US at the end of July and look for work.

We plan to move in with my parents and have them as joint sponsors.  Although I am currently living and working here in the UK, which address should I put on the I-130 for my residency (question B2) ie..my parents US address, or the UK address?

The G-325A form asks what were your last 5 years of residency.  I was wondering if I should put my UK address time frame from the month & year we started here to July 2005 and then put my parents US address and time frame from July 2005 till Present...is this correct?

Then with the work details should I do the same?  Should I put my abroad work time frame from the date I started till July 2005 and then put "NONE" (since I won't have a job immediately when I return to the US) in the time frame from July to Present?

Has anyone else experienced this problem as well?

Any help is appreciated.

Thanks

first of all - this is absolutely not legal advice.

I lived in teh UK when I filed my (now husband)'s fiancee visa.

I called the INS.  Actually, I IM'd my mother who was on the phone with the INS back in the states.  They said to put the address where I was currently.

My situation, however, is different.  I left for the US within a week.  Before our application reached the Texas Service Center.  Therefore, I went ahead and put my parents' address in the states.

As for the job, i put where i was employed as October, 2002 - present.

I know that really doesn't answer your questions, but that was just my experience.  I highly reccomend posting the same query on  http://britishexpats.com/forum/forumdisplay.php?s=&forumid=35  as most people there are in similar boats.

also, the vermont service center is pretty fast!

good luck!

I made photocopies of all the forms I filled out so I could answer questions like this, and now I can't find the forms! Gar!

On the I-130 I remember including 2 addresses for myself. I put my US address (which like you was going to be my parents), but if memory serves there were 2 places for an address on the front page. (I've tried looking at the I-130 but I'm having problems with my adobe and can't seem to view pdf's at the moment). I assume you've got the form with you, is what I'm saying making any sense? :-[

For the G-325A form, I only included residencies in the last 5 years until present - on the exact day I filed the form I put my current English address on as 2003-Present, or something like that. I didn't incolude my US parent's address on this form.  I'd have done the same with work details, but I didn't have a job.

This is all a bit fuzzy (I wish I could fine my forms!) but we went to a lawyer and asked him these exact questions, and he made it sounds like the G-325 stuff (the geographical info) didn't need to have the US residency on it.

I hope this makes at least vague sense. Since I'm not sure about it though, it can't hurt to email the Embassy (calling is a waste of time) and ask them. It is in their interest as well that the forms are done correctly.

Sorry I can't be more help!

Thanks for your help both of you!

I e-mailed the US embassy and they did not bother to reply  :(
I have sent the forms off now. I put on the I-130 my American address ( I read some where that there had to be a US address on the form) and put my last residence on the G-325 as the UK address, I also clarified my position on the covering letter so fingers-crossed I will hear some good news soon!

Thanks again

Sounds like a good plan, especially the cover letter part. Good luck with it all, and keep us posted!
