Sticky question...
« on: June 10, 2005, 07:58:17 PM »
I am currently on the 18 month of my flr preparing to apply for ilr in oct./nov. We had been married three years when we moved here so I could not apply for ilr right away.
However, the thought came into my head recently- could I not have applied for ilr after we passed our fourth anniversary? That would have been last summer.
Up until November 2003,  we were living in another European country (I am American, husband is Brit).
Could I apply for ilr now even?
Just wondering?????And kicking myself if it was possible with this ridiculous hike in price...
Thanks

Can you lay all the dates out in chrono order?  We'd need the dates because it's important to know what the rules were at each time...

Married July 16, 2000 in US
Lived in Romania up until September 2003
Applied for FLR November 2003 in Chicago
Moved to UK November 11 2003

My question is- could I have applied for ILR as soon as we passed our fourth anniversary or do I have to wait until FLR expires.
Thank you  very much for any info....

Now I see what you're after!  Sadly no, you did not qualify for ILE on the basis of four years marriage at the time you moved to the UK in 2003 - so that path is gone.  When you had your 4th anniversary, you were 7 months into your FLR and had not accrued the time needed to complete your probation, so had you applied on your 4th anniversary, they would have kicked out your app in the pre-sift.  The earliest time you will be eligible for the concession is in October, 2005.

Hypothetically, had you waited until July 2004 to enter the UK on ILE on the basis of four years marriage, i.e., another 7 months in the US, then your status would have been the same in 2004 as it will be November 2005.  But that's gone by the boards.  And you came in too late to have an opportunity for avoiding the higher fee.

So given those dates, you could not have done anything differently.
