Best, easiest and quickest way to be together
« on: July 07, 2005, 06:01:22 AM »
Just have a few questions. This is the scenario, I am a US permanent resident, been here in the US for 10yrs. I met my fiance 2yrs ago and he's a british citizen. We want to be together now. What is the best way to do this, get married here and then i move to UK or i'll file for my US citizenship, get married here once that's done and then sponsor him to stay here as my spouse? I've read a few of the topics here but nothing much on a british citizen moving to the US. If am to move to the UK, will be the process be different since i am not a US citizen? If he moves here, how long will it take before he can come here (let's say i'm already a US citizen)Please help. Thanks.

The repatriation board has all sorts of info about how to move from the UK to the US.  I'd check that out.  :)

If you're moving to the UK, most people say that the easiest thing is to get married in the US, go to the consulate there in the US and then move to the UK.  But it all depends on your circumstances and I would assume you'd need to get your American citizenship first.

I'm a filipino.

Fine.  So you can use your USA residence to apply from within the USA.  But as a visa national, you would prepare for a T4 processing.  It means they will need to check with the consulate in Manila to help find out who you are, and that may add some time to the processing of your application.  Maybe 4 weeks or so.  If you have a prior marriage in the Philippines, add two weeks or there abouts.  There's some tips about preparing for a T4 interview at my site, but since it will be in the USA, it's a good bet that the ECO will be rusty on it...

The consulate in Manila is running 10 - 14 weeks to schedule the interview, so you're lucky on that count!

Hi- I'll offer some advice since I'm in the same boat (well, almost- I'm not engaged yet!)

I've been a PR of the US for about 13 years, and my boyfriend's British.  After researching immigration options, I've found that the best route would be to get your US Citizenship ASAP because that makes things a whole lot easier.  If you move to the UK, it gives you flexibility to come back and live in the US at some point (as well as not having hassles when you come to visit!), and if he wants to move to the US, you are immediately eligible for him to come over (and get a K1, etc.)  You can marry him and then file to bring him over, but as a PR you are a lesser priority for US Immigration and you get I think it's 2nd or 3rd preference when it comes to the fixed allowed numbers of new immigrants each year (which does not apply to fiances/spouses of US Citizens) and so the application will most likely take a few years (as opposed to several months if you are a US Citizen.)  Also, as a PR, you cannot file for a K1 to get him over to the US as a fiance and then get married- that visa is available for US Citizens only.

I haven't had any experience with the UK immigration system, but from things I've read/the hell I've experienced with US immigration, it seems to be a lot easier to move to the UK as a fiancee/spouse than the other way around!   (Can anyone confirm..?)  Hope this helps, and good luck!!
