Topic: Sending Documents to NY today for Spousal Visa.....Need Advice  (Read 1215 times)

Hello I am new to this board......Ive been reading all of your posts, and found them very helpful. I have gotton all of my documents together and sending today.......Wanted to double check to see if you guys think it's enough......Also what are the chances of being denied? I dont have a criminal record, never been refused entry to the UK etc. Nothing to hide......Basically I  WORRY ALOT !!!!! I have packed up all of my things & sold all of my furniture etc and just now left my job here in the USA. So, if it goes wrong I am in deep trouble  :\\\'(  Not to mention the fact that I am staying with my menapausal mother till I leave !!!!!  :-[  I will be using a facilitator (visa service in NY) because Its cheaper than driving from South Carolina.....+ I have a job interview in London mid August and already got my airline tickets booked for the 10th of August.....Should I tell them that???

COMPLETED APPLICATION FORM E-fastrack system  X 2 (myself and my daughter)

 2 RECENT PASSPORT SIZED PHOTOGRAPHS. X 2 (myself and my daughter)

 APPLICANT’S VALID PASSPORT. X 2 (myself and my daughter)

Spouses British passport  X 2 (old one showing visit to USA & New Passport showing other trips to USA)

Spouses long form birth certificate

Marriage Certificate

Divorce papers showing the date the divorce became final (1st marriage) & Official Translation

 Letter of support from my husband

 Tenancy agreement for private rented property

Letter from spouse’s employer in the United Kingdom stating the position in the company, length of service, annual salary

Recent statements of bank and saving accounts showing sufficient means of support

Enquiries made regarding employment in the United Kingdom. (Emails)

 Birth certificates naming both parents, for my daughter

Custody order providing for full legal custody of my daughter & Official Translation

Various E-mails between myself and my husband

Copies of wedding pictures

Various cards, etc from wedding.

All organized in an accordian file and labeled for them!!!!!!!!

Even though you have full legal custody of your daughter, you may have to still get her father's actual written consent before they'll issue a visa for her.  :-\\\\

That was what I was afraid of......Problem is the last that I heard he was serving 15 years in a Spanish Prison......I haven't had contact with him AT ALL, since the divorce and we were seperated years before that. I just got the papers in the mail one day.(divorce and custody) and No return address. He didn't ask for any visitation at all. He did that so he wouldnt have to pay child support. I dont even know where to begin, finding him if I had to. What would they do in this case??? They asked me for all of these papers as well when I went to get her US passport and I ended up signing a statement explaining the situation, and eventually got it. My husband is in the process of adopting her as well. Which I think is all for the best.

I was always curious about this as well. there are many single mothers out there,plenty of them the fathers want nothing to do with the child. how are u suppose to actually show proof of this?

Do what you did to get the passport, sleepless.  That should be sufficient.  If you got your daughter her passport on your own after the law went into effect needing both parent's signatures, and you show the consulate what you showed the passport people, then you should be fine.  They'll know you would have needed his signature to get the passport and hopefully figure that if the US government issued her a passport just on your signature, then it should be safe to issue her a visa just on your signature, given the circumstances.

In most cases, though, I would presume that one would have to do something akin to placing notice in the local paper or the paper local to the father's last known residence.

I was lucky in that mine is the only name on both my sons' birth certificates, so I had no problems with passports, visas or (last) name change.

Hi everyone!!!!!
Thanks for all the replies. I went back on the UK consulate website and re-read the rules......this is what it says:
Children by Previous Marriages
1. The custody order showing that the natural parent has been granted custody of the children. I have this..
2. If the custody order grants any form of visitation rights to the other parent (i.e. the former spouse)then we require either: The custody order does NOT grant any form of visitation, he didn't ask for any. So I guess (according to what it says here, (a) and (b) don't really apply.....I sure hope not.

a) A notarised statement from the other parent that s/he is aware of and consents to the proposal that the children concerned should be allowed to settle in the U.K.;
Or/


b) if the agreement of the other parent is for any reason not forthcoming then we require a court order from the court which originally granted the custody order which formally alters the terms of the custody order and allows the children to settle in the U.K

Her biological father has 6 children in 3 countries and does not have any contact with any of them.....He is a real piece of work! 1st and last time I say this...LOL I should have listened to my mother.!!!!!!!! Hey I was young and we all make mistakes....... Got an instant message from a member here telling me write a letter to the Consulate......So, I did. Think I may have went a bit overboard LOL about him, but hopefully they will see him for what he is .......I hate to think that my life depends on once again......HIS actions! Made my life a nightmare & still is. Oh well, hopefully it all works out! Heres the letter I sent to the consulate:

Dear Sir/Madam,

Please note that my ex husband does not have any rights to my daughter whatsoever. (see custody order)  He did not request or receive any visitation in the order when he voluntarily gave me full custody. Nor was he ordered to pay any type of child support. We do not have any contact with him and haven't in years. Which is for the best. She can't even remember him.
 I did manage to speak to his sister in 2002 and over a year later in 2003 I received the order granting me full custody. The last that I heard of him via one of his other childrens mothers, was that he was in prison in Spain and would remain there for the next 15 years. That was around christmas 2004. He has fathered AT LEAST 6 children in 3 different countries, with 4 different mothers, and has no contact with any of them as far as I know.
 My husband has made enquires from within the UK and we will be going foward with the adoption process/name change as soon as we arrive in the UK. My husband has been sorting out her school, after school club etc. there in the UK as well as getting her room ready etc. We are all very excited about beginning our life together and hope that we will be allowed to do so.


Wonder if that will be good enough???
