Can we use one 1116 form for all of our UK wages?
« on: January 22, 2006, 03:32:23 PM »
My husband and I (both American citizens living in England from May 2005-present) would like to file our tax returns jointly, so I am writing to ask if anyone knows whether or not we can combine our foreign income onto one 1116 form, or are we required to fill out separate 1116s?  I don't see how it is possible NOT to fill out only one 1116 form because it asks for the standard deduction from our 1040, and if we are filing jointly, that deduction is for the both of us as a married couple.  And do we have to include proof of foreign income on some sort of alternative/subsitute W-2 ?  Thanks for any help you can provide!

Ideally, you would file
Form 2555 - one for each of you, giving you a lower tax than just the 1116 and making your filing date sometime between May 2006 and Jan 2007, depending on how many days you returned to the US between May 2005 and May 2006.
Form 1116 - one for general limitation income (combining both of your wages and also any UK interest for you and/or your husband if either or both of you are higher-rate taxpayers in England) and a second one for passive income (interest income if you are not a higher-rate taxpayer in England).
Form TD F 90-22.1 - if your UK bank balances ever exceeded $10,000 at any point during 2005.

Tax software should make this an easier process for you - try Intuit's TurboTax - but if you are high wage earners (well in excess of $80,000), you may wish to consider hiring an expat tax prep company to squeeze every last drop out of the IRS.

Thanks for your help.  Because of the insecurity of my job here, we may not meet the physical presence test in order to file a form 2555.  If we're here less than 330 days, we'll have to just file a 1116, but if we do hang on long enough, we'll definitely file the form 2555.  Thanks again for your advice!
