Good Dilemma! Help!

Well, it seems that David's old colleague wants to hire him in the USA.  In an ideal world, starting in August-but we really need one bonus of mine more and i get that paid in Feb.

She was asking him if he would be able to work from here for her, so quitting hs job now and being a rep for her magazine from London.  He would have to do a week or so's travel in the US, which he used to do, but this is a US company with no UK branch.....so i'm assuming this isn't possible?

Another question.  I was going to file for ILR in August-we would turn around and file for DCF in September.  If he got that granted in say December, could HE move back to the US first, and then I would follow 2 months later?  Or would i enter with him, then fly back and finish my job here in March?

It's all a bit amazing and complicating but exciting as it is the leading magazine in the field and would be a good job for him for a while.  Plus we could live wherever we want on the east coast

Any help would be appreciated.   :D

Wow I have absolutely no insight or advice but congrats to both of you!  that sounds like a really good problem to have!   :D

Okay, I need some more info.

What is his current status in the UK?  Will he be eligible for ILR soon?

Victoria,

I am the US citizen.  We were going to file for ILR for ME, and then turn around and file DCF to get him back to the US as my spouse. (we will be married 2 years at the end of august). 

So he is a UK citizen.......the US company wants to hire him.....and in my mind that says THEY need to file a work visa for him.....but he'd not want to go until January and I would stay here in the UK without him (with my ILR) until the end of March.  Sad, but good for us.

PS he did NOT go looking for this.  At all.  Past clients and colleagues chased him down!

I can't see a problem with a UK national working for a US company whilst physically present in the UK, providing taxes are declared and paid..  As long as you have your ILR by the time he leaves, then you can stay here without him.

I'm not sure that I understand what the problem is.

I think she's worried about losing her ILR by a relocation.

But Aimiloo weren't you planning to relocate back to the US permanently anyway?

we were geetak!

I had 2 questions i guess:

1. If the US company hired and paid him for work, even though they have no UK branch...and all his travel and business would be US based.  I think the company is figuring this out for him, if it's doable.  If so, he would start in august for them, and work out of our apartment.

2.  I was worried if he moved back to the US without me, it would be breaking some rule!  That's all!!!!!!

There is only a breach of the rules if he moves out before you have your ILR, so it all looks good to me!

Congrats!  I'm reviewing the I-130 and G-325A forms as we speak.  I am SO hoping we can move soon, but all I can do is the paperwork and pray that hubby gets a job!!!  

Congrats again!!!  Will you be in MA?
