Important Question

Hello everybody,
I dont know if this is the right section to post my question, but if this is not the right one so please moderators can remove my thread from here.

I have a friend who is living in Us, with no papers, and he dont want to go back in his country, but he has a girlffriend which is living in Uk, and she has Uk visa which is valid to the end of her life, I forgot what is exatly the name of the visa, but it's probably something like citizenship. So the question is, if she came here in Us, and married him is he going to take her status of Uk citizen, and is he will be able to move with her in Uk?

It's impossible to answer your question properly without knowing whether the girlfriend is on a visa or has citizenship, they are not the same thing.  If she is a British citizen then yes if they marry in the US he can apply for a visa as the spouse of a British citizen.  Whether the application is successful is another matter however.

Wouldn't he still have to return to his home country to apply for the visa though?

Yes...and he would have to submit his passport in order to get his UK visa etc....don't think he is ok to do anything while in the US illegally. If I were him I would be very careful.

It sounds like the UK gf might have ILR...in which case she can sponsor him as a spouse or fiancee.  He will *definitely* have to go back to his home country to apply for the visa, and of course if the application is unsuccessful he won't be able to return to the US.  I would suggest that he makes sure he has all his ducks in a row before attempting an application...good luck  :-\\\\
