Finding work before repatriation
« on: April 30, 2006, 10:34:51 PM »
Hello all

I have just got my ILR and DH and I are considering the possibility of repatriating. Just wanted to ask: is it possible for DH to seek employment in the US before we do any paper work? Or do we have to get a spousal visa for him before he can start looking?  I have no idea and knew someone here would know.

TIA

Doesn't anyone know? Can DH seek employment before he gets a green card?

I don't know as my hubby is wanting to do the same thing!  If I find out something, I'll post it and if you could do the same, that would be great!

To be honest I am not too sure.

My husband had an interiew with the US division of the company he worked for in the UK.

It was never brought up in his interview or paperwork if he had a job to go to.

I don't see what the harm in looking is while the paperwork is being processed.

My husband got transferred with his UK company into the US in a roundabout way, so I'm not sure.  :-\\\\ You may want to pop into diveintoamerica, a repat forum, and see what they have to offer. :)
I'm done moving. Unrepatriated back to the UK, here for good!

I am pretty sure that you can seek work in the US prior to legally being allowed to be employed here.  I say this because some of the foreign postdocs in the labs in my building are doing this.  They are legally employed in their current positions, but can't just switch employers.  So they are seeking employers willing to sponsor them.  But bear in mind that the US spousal visa process takes significantly longer than the UK process (I think).  So you should be careful that he doesn't start looking too soon, as his paperwork may take a while.

Yeah I think it is fine for your DH to look for work - looking is no big deal.  Companies may not want to employ him based on his status but he can always cross that bridge when he comes to it.  When we used to interview candidates in the US, they sometimes needed a work permit to accept a position.  We just noted that as part of the process but it never really raised any red flags as such...

I think I've found out (can't remember what website) that he can apply for an actual permit to seek employment after the application has been filed. So he can legally seek employment AND work while waiting for the green card to come through. Is that right? The website seemed to imply that he probably should not bother looking if he hasn't started the application process. At least that is my confused understanding of the matter!
