Supporting Evidence for ILE
« on: May 08, 2006, 04:38:02 PM »
I am starting to gather all the paperwork and evidence now for my spousal visa application.  My 4th wedding anniversary is on June 28th and I will be applying after that date, in hopes of getting ILE.  My husband and I lived together in the US from our wedding date until April 10th of this year, when he returned to the UK to start getting things set up.

Will I need to provide evidence that we have a real marriage (like the 10 documents a year required to convert FLR to ILR)?  Or can we just send in our marriage certificate and joint bank account statements from the past few months?

Also, since I first entered the UK on a now expired passport, should I plan on including the voided passport with the application as well as my current one?

Thanks.

Does anyone have any idea about this?  Has anyone on the board moved to the UK after 4 years of marriage?  It seems like most people went over on fiance/e visas or spousal visas immediately after marriage.

It's not strictly necessary to provide evidence that you have been living together, and you certainly wouldn't need the same amount of dicumentation that you would need to provide if applying from within the UK.  However, I think it is a good idea to show a little evidence, just in order to reassure them that you have remained in a relationship for this time.

I think it is a good idea to supply to old passport too.

Thank you very much Victoria.  I've order our tax return transcripts from each year we were married and can include things like leases, car titles, and joint account statements.

I'm going to do a search now to find the answer to this, but if anyone happens to read this question and know, feel free to answer it...

Can you send in photocopies of things like the leases, titles, and statements?  Or will they have to be originals?

Off to run my search.

In case anyone is searching for this information in the future, I'll post the results of my search.

Here is an older thread I found regarding the requirements for submitting an original deed.  One respondent had a certified copy made, and one simply had the document faxed to the consulate.  So it is not entirely clear.

The photocopy of the passport must be a true copy of the original and certified as such above the signature of a British practising solicitor or notary public.

The Entry Clearance Officer may be prepared to accept ordinary photocopies of other supporting documentary evidence, but this cannot be guaranteed.

Any original documents sent will be returned.

I also searched the BritainUSA website and found this:

Official documents must be the originals or official copies bearing the seal or stamp of the issuing authority. Birth certificates must show parentage. Marriage certificates must be the civil certificate issued by the registrar and bear the raised seal or stamp of the issuing authority.

It doesn't mention certified (notarized) copies, and since there is no issuing authority for my leases it sounds like I'll need to send in the originals.  I guess I'll skip sending the title in.

Certified copies are fine.
