British citizenship regs for EU nationals
« on: May 10, 2006, 04:11:55 PM »
Ok, let's say I came to the UK on a fiancĂ© visa, and then switched to FLR(M) after the wedding.  In the meantime, if I've been granted citizenship of another EU member nation (through ancestry), while I was in the UK on FLR(M), what are the British citizenship implications?  Do I still have to wait until I have ILR and have been a UK resident for 3 years, or is there some kind of fast-track British citizenship qualification for EU nationals living in the UK?

No fast tracking.

If you were not married to a UK nationa, you would have to wait 5 years before getting your ILR then citizenship.  As you can get citizenship after three years as a UK spouse, there is probably little advantage to getting EU citizenship once you are already here.

Ok, I have to ask why.  Does it look like I'm just collecting passports?

No, not collecting passports.  Empirically, EU people are not doing that - even when they qualify.  For some, it's the accrual of obligations, and the complications in which government is supposed to do what for you.  It's really something to take up, not so much with an advisor, but rather with an EU nationality specialist, preferably in the EU member state where you expect to acquire nationality by ancestry.

But to reiterate Vicki's point, there are no pathways for an EU citizen to acquire British nationality on a fast-track, other than the standard fast-track of marriage to a British national.  To tack on to what Victoria said, it needs to be 5 years exercising treaty rights also - and no telling *what's* going to happen there.
