FYI MA residents moving to the UK
« on: August 23, 2006, 01:02:51 PM »
I've been concerned about how to file my MA state taxes when I move to the UK so I
sent the MA tax people an email. Amazingly I got a quick and clear answer.

My question

"Can you tell me how a person should file MA taxes in the following situation.

A US Citizen domiciled in MA moves to the UK to take up permanent employment with a UK employer. They will be in the UK for an indefinite period, but longer than 5 years, they have no current plans to return to the US and if they do they do not know to which state. They plane to buy a home in the UK and will become resident and ordinary resident according to the UK, however, the UK will not consider them to be domiciled in the UK. How should the individual file their MA tax return?"

MASS DOR answer.
"Thank you for your recent inquiry.
Based on your details you would be giving up your Mass domicile, and after the time you leave your wages would not be reported to Mass.No return would be needed for following years. If you are in Mass for part of 2006 file as a part year res."

I hope to move to England from MA next summer. Thanks so much for that info!! I'm so glad I'm not in one of those states that will have to file every year!!

Woohooo!!!   ;D

I wonder if this is written anywhere else though, I would like to have official documentation, just to cover myself in case they try to say different later. You never know!  ::)

Scarlett - masterblaster is relying on his/her facts. These imply that s/he will file a form DOM1 claiming MA domicile with HMRC in the UK.  In the circumstances described the position s/he is planning on taking remains at risk of audit.

What I did was move from MA to my parents home in Florida a month before my move to the UK (complete with getting FL licence and registering to vote there).  Did the part year resident form for 2005 and that should be the last I have to deal with MA DOR.

Guya, how do you suggest someone domiciled in MA and moving to the UK for a permanent appointment should approach this
situation. I feel that I will be fullfing all the requirements to give up my MA domicile, but I also see that as the US is a Federal entity there is a requirement to declare domicile in a particular state as well. My father was born in NH, but has lived in MA for most of his life and I've lived there all of my life apart form the 3 years I spent in CA. There are elements of Catch 22 in the way MA defines someone domiciled in MA as being resident for tax as well. Any practical suggestions?
