Hello There all;
Ok It might that I came across the right forum who could finally hand me information on this matter; ok I am european have european id and passport since my Mother is european ok?

also, I have a pension that was given to me by the spanish gov social security, it´s a permanent incapacity total..that´s what´s called here in Spain, the pension itself in Spain it´s exempt from taxes by it´s nature, some other pensions are not but this one it is; ok on my planning to check things before moving up to the UK, I called from Spain 10,000 places internal revenue etc.. to check if I had to pay taxes once I am up there..

see..my case is different since being european I can go and move without any problems to the uk, they stated me that yes..i would have to pay taxes since in UK the pensions wich are incapacity permanent are taxable,:(
but there is also a double taxation agreement between Spain-UK that exempts this pension from taxes..I talked to an inspector and he told me that he would need to the pension statement to determine wich exactly is the pension...they have it on a london traduction department and he will get back to me....

according to their internal revenue policy the pension would only be non taxable if itw as given before 1995 wich is not my case since it was given after 1998, and I can´t consider it a dissabilty allowance since I am able to walk and get around so.. it seems like I would have to pay taxes on it,! but the question comes when how do they determine I have to pay it? I mean what If I live here for 5 months then go back to Spain then come back after 2 months or 1 month...you pay taxes only when you are a ordinary resident etc..? I mean for spanish citizens we don´t need any type of residents card in the UK, all other european countries after 6 months you are obligated to have a permanent residents card..but here you don´t...so what they based themselves to charge me taxes?
I checked how much they would charge me..see what I do is i have a banka ccount In Spain and once my pension goes through I myself just do a transfer via internet of my funds into a british bank account..so I guess that´s where they track an income is inn...

I barely get 1,000ks pounds a month,since the pound towards the euro is so strong..I get here in spain 1,466 euros but when you convert that into pounds it stays in barely 1000, from that they said they will take 105 pounds,

I don´t even know if they will give me anything back??
if you consider from that amount me paying rent, council tax, gas, water, electricity, gas for the car.. tv license.. once and while a pair of shoes.. medical prescriptions...here in Spain the prescriptions for being pensionist are free..seems like NHS also charges the prescriptions in my case!!!!
a friend told me once I get up there I should go to social services and explain them about all this sh*t.. 1000 is barely money to survive and i should get a discount on tax of a 25% but also a larger one in my case...also on NHS I should get some advice on this..

and finally what on earth they consider by being resident or not? I mean i could just shut my mouth and don´t say anything and just enter and leave the country?? but I want to act legal on this case but no one seems to even know anything about this..
I was also wondering if there is any tax organization consultant that could help me based in London Luton where I´ll mostly be living??

I´m kind a´desperated..seems like living in Spain it´s much more cheaper for me than going to the UK.....

I am confused.

1. Your post on July 19 stated that you moved here from Raleigh N.C.
2. You are now saying "here in Spain".  This is a forum for Americans.  I don't think this community is familiar with Spanish
/UK disability rules.
3. I suggest you visit a Citizens Advice Bureau in the UK who will help with benefit and tax related problems.

I am dual citizens that is born and raised in Knoxville TN and also spanish nacionality!!
now if that´s a crime excuse me!!!!!!
I mevere xpected this was exclusively for americans wich I am also!! and not for any one else in the world!! :( :(
God sometimes this is one of the reasons we americans are so hated outside the world..for these type of comments!!
well ok so being spanish nationailty because my Mum that excludes me from asking for help and advice on this forum ? right? how nice and kind..Thank You so much!

I did move from NC and living actually in a share flat in Beds.. but now am on vacation in Spain with my folks..is that fair enough??

I don't read guya's message as discriminatory at all.  Your original post is quite confusing and you didn't state anywhere that you were a citizen of the US.  In fact you didn't once mention the US or being American, so I think it was quite normal for guya to assume you were not American.  I think your situation sounds quite detailed and you probably will need expert advice - more than you'd be able to receive just on an internet forum.

an internet forum that IS, as the name states, UK-Yankee.

We just might not be as up on spanish or european law as UK, as sadly they are all indeed different!

I think what Guya is saying is that this is a question that would require expert knowledge about Spanish and UK laws, and to be fair I don't think you'd find that on a forum for American expats.  You were given good advise which was to contact the CAB.
