I'm American my husband English. I am here in England until 2009 on a spousal visa. We want to immigrate back to the US.
I phoned USCIS to ask some filing questions where the operator to my dismay told me I had to file his forms within the US and if I wanted to live in England during this process I would have to prepare to fly home for any interviews in the US. But at the end of the call she said "oh but check with the us embassy in london to see if you can file them there".
I went on the US Embassy site in London and it says...
Note: If the U.S. citizen and immigrant visa applicant reside in the United Kingdom and the U.S. citizen is filing the I-130 with the Department of Homeland Security (Immigration) in London, it will be possible to begin the administrative processing of the immigrant visa application before the petition is approved and received by the Immigrant Visa Unit.
As I can't say I feel like spending the £1.20 per minute to talk to someone at the US Embassy can anyone on here tell me if this informatin is correct?
Can you file the I-130 within the UK?
I really hope their information correct on the web site bc I'd really hate to have to be seperated from my husband to file these papers
