When do you file taxes in the UK?

Did you give your employer a P45 from your previous job or did you get asked to fill in a P46?

i just moved in july so i didn't have a P46, I don't remember filling out a P45

If you just moved here then you should ask your employer for a P46 form to fill in in the first instance.  It sounds to me as if you're on emergency tax (Basic Rate) and the first point of resolving that is to get a P46 form completed.

Your tax status isn't determined by your employer so they may not offer to assist you (it's between you and HMRC) but they should give you assistance in filling out the P46 and sending it off (to be honest, they really should have done that right from the start)

1. If you started work in July 2007 you won't be getting your first P60 until July 2008.

2. You are probably paying tax using a Month 1 Code because you have not yet filed a Form P86.

3. Your employer can tell you which tax office & reference number to call.  They can't (& nor can I) say if the withholding tax is too much or too litlle because they and I do not know how long you expect to stay or if you are UK resident for the current 2007/08 UK tax year.  Your residence status needs to be ascertained to decide if you are entitled to a UK personal allowance for the current tax year.  If you are UK resident then you get a personal allowance which HMRC will allow in the tax code they will issue to your employer once you have filed the form P86 and asked them to adjust your code.

Ah! 16 Jul 07!  I don't know why, but I thought you meant July 2006. 

As it's 16 Jul 07, you won't get your P60 until June of 2008.  Talk to your payroll department if you like, or talk to the HMRC if you like; but if they can't do anything about it now, rest assured you can reclaim it at the end of the year by the method I described.

Big, big caution here!

Because castabear expects to stay for only 1 year at the outset she won't qualify for a UK personal allowance unless she is present in the UK for at least 183 days in the UK during the 2007/08 tax year (not counting days of arrival & departure).

We just don't know if that is true which is why I suggested a Form P86.

Good point, Guya.  The calculation I did assumed the personal allowance would be allowed.

Okay so I'm confused you're throwing too many P-6s at me

do i fill in the P46 or the P86? 

As far as I understand it, the P86 is if this is your first job since entering the country whilst the P46 is if this is your first job or if your previous employer didn't issue you with a P45 (a record of tax paid in your last employment).

I would imagine uour employer is likely to have a supply of P46 forms more readily available than P86's. 

As an alternative, you could find out from your employer which tax office they file with and their reference number and you could phone them direct for guidance?

My employer had me fill out a P45... he says I'll get the money back in my pay. here's hoping, i'll keep you posted.

Good luck, they're normally pretty good at making refunds when they're due.  I just started a new job also and had to wait 7 weeks for my P45 from my old employer so i've had two pays on Basic Rate...hoping to get the tax back in my November pay in time for Christmas shopping!
