Visiting the US after abandoning residency
« on: February 05, 2008, 01:57:40 PM »
I'm really confused. We'd like to visit the US sometime this year. However, I have a green card. I have not technically abandoned it, although I have been gone over a year without a re-entry permit so expect I have technically abandoned residency anyway.

We do plan on moving back to the US eventually, we are still filing US taxes etc., and have things in storage there.

So, when we go back to visit, what do I do? Try and enter on my greencard, or a visa waiver, or some other option?

My (British) husband had his green card expire (after a year) when we moved to the UK. So, he had to enter the US like any other visitor would.

When we moved back to the US, he had to re-apply for a green card. Things got a bit tricky when he applied for citizenship, because they had two reference numbers for him. Essentially, it meant that the process took a little bit longer because they had to double-check things.

This is good to know.  We left the U.S. in August.  Before we left my wife had applied for citizenship because we had been married for 5+ years.  Only after being in the U.K.  was it explained to us that she need to be living in the U.S....so after $650 we are planning to abort the process and will have to do as mentioned above when we return...start from scratch.

We will be dealing with this as well. I've read that you are suppose to turn your greencard in when you abandon residency.

No problems at all as a visitor. Just went right through the line like everyone else. However, when we moved back in Sept. 03 they took him to a room to question him for awhile.

By the way, he didin't turn his green card in until he reapplied.
