Topic: I won the Credit Card dispute, now they sent it to collections?  (Read 1070 times)

In December 2006 I rented a car in London for ten days, turned it back in and received a slip stating no damage, the car was fine.

Two weeks later, without anyone talking to me, the rental company charged my card $2600. I did not see this until February and disputed it with my card company. For various reasons it took until October or November of 2007 to resolve it in my favor with my card company and they reversed the charges back to the rental company. Great, all done, or so I thought.

Now in February of 2008 I receive a collections notice from a company in England saying I still owe this money. I thought that once the credit card company resolved the dispute that it was against the merchant agreement between Mastercard and the Rental Car Company to continue the issue.

Some other information that might be helpful.

 - I am an American Citizen, using a card from the US but I don't live in the US. I don't live in England or anywhere in Europe either.

Anything I should do? I don't think they can, or will bother, to sue me for this amount across countries. Can they sell the debt to someone in the US? Can they affect my credit report? I still have the paperwork from both the rental car company, who provided the original return sheet stating that there were no problems with the car, and from the credit card company stating that they agreed with me and reversed the charge.

The credit card might have reversed the charges but that does not take care of it completely on your end, the company still shows you owe $2600. I would get on the phone pronto with them to find out what the charges were for.

Do you still have the slip showing no damage? If so I would scan a copy and send to someone in the company so they can pull it out of collections. I would also request a detailed written explanation of the charges they say you owe.

If you get it resolved make them send you something in writing showing just that.

I know what they said it was for and I disputed it with them and the card company. I still have the paper that says it was in fine condition when I turned it in. It is my understanding that as a MasterCard vendor that they agreed to accept their decision an NOT to continue the issue if they lost during that dispute resolution. That is what I am trying to find out.

I had the exact same thing happen to me with a rental car in France.  And you are right, now that the charge has been charged back to the rental company, they can not come after you for the money.  You can call them, or better yet, send a letter stating you are no longer liable for this money as you have the paperwork showing the car was undamaged when you turned it in and that the credit card company agreed with you by reversing the charges.  They should therefore cease and desist these harassing, even illegal, letters.  You can find lots of example cease and desist letters on the web as a guide.
 
When I was involved with this situation in France, I told them that any damage they claimed to have found on my car must've been done AFTER I had already dropped off and had my car inspected.  The car rental place was at the busy port in Calais, so it was entirely possible.  I wasn't worried in the least when I received a letter from them claiming I still owed the money.  Were they nuts?  Even though I had paperwork saying the car was fine, and I had the charges reversed from my credit card company, they still thought I would pay them?  Whatever  ::)
I sent them a cease and desist letter and left it at that.  I never heard another word from them.  I don't think it was because my letter threatened them or anything, but rather, they knew they were dealing with someone who could not be scared into paying money they knew perfectly well I didn't owe. 

And let's face it, this isn't a criminal case, it's a simple payment dispute.  It's not going to follow you into another country or anything like that.  I'm pretty sure that it could only follow you if you were resident in another EU country.  Since you say you are not, then don't worry about it.  Even if you were resident in the EU, they'd be foolish to bring a case against you.  You have all the evidence on your side.  The most important evidence of all is from their own company stating the car is fine!  Anyway, I really doubt they'd take it that far.  Also, they do not have access to your US credit report - they don't have your social security number - so don't worry about that either.

Just remembering that whole car rental incident in France still gets my blood boiling.  I swear it's a conspiracy or something against so called "rich" Americans.

I'm still being billed for $904 on American Express for items I didn't charge.
The matter is being investigated by them. This is the second time. The first time they said they couldn'y credit my account for the amount charged.
I'm boiled. It isn't my signature on the charge. They want 6-8 weeks to investigate the matter.
