My US husband is having his biometrics today. We have a file full of paperwork all ready to submit to LA after. I am worried sick that something will go wrong with the application. He is unemployed, I earn around £30,000, we have a rented house in the UK to live in together. He has no income other than that which I send over to him and so he has no wage slips, bank statements to send in.
Also the confirmation email we got following the submission of the online application listed supporting documents as:
* completed application form VAF2* your current passport
* your old passport or a copy of it
* Immigration status (Original not copy):e.g. Permanent residence card, Valid I-94 H1-B - L-1 - B-1 I-20 (Signed on reverse side) IAP-66 Employment authorisation card with advance parole document
* evidence of funds available to you, in the form of detailed bank statements covering at least the last three months
* a written invitation from your sponsor in the UK (if applicable) and a copy of their British passport/EU passport or UK residence permit
* your original marriage certificate
* evidence of your sponsors accommodation in the UK, for example mortgage or tenancy documents, etc.
* evidence of your sponsors employment or intended employment in the UK, for example a contract or offer of employment, salary slips, etc.
* evidence of contact between you and your sponsor for example letters, email, telephone bills, etc.
* One recent colour passport photograph (not more than six months old) Please note: scanned or copies of photos are not acceptable
I sent in a certified copy of my passport, and it does say copy on the list, but I am reading conflicting things on these forums that say original sponsers passport needs to be sent.
I spent a long time piecing together all the paperwork, everything is original documents except my passport which is a certified copy. Could anything go wrong? How many spousal visas get rejected? Dont know how I am going to get through the next weeks.  [smiley=bleck.gif] [smiley=bigcry.gif]

I'm so sorry you are so scared about this, but I do understand. It's such a long terrifying process.  Just try to be patient (so very hard to be) and hopefully everything will work out as it should.  You are already married I don't see how they could turn him away. Good luck to you!!!! And try to busy yourself as much as possible so you don't end up sick and crazy, I know that from personal experience...I'm already there :-\\\\

O I know, trust me I feel the exact same way actually.  My fiance is telling me that I need to calm down and relax, God love him, makes me want to strangle him  ;) If you ever need someone to talk to, you can always message me and I will answer probably right away as I am glued to my computer lately  :(

First off *HUGE HUG* for you DarkSunrise.  :)

I felt exactly the same way you do just a few short months ago. It's such a scary process and you will imagine every single thing that can go wrong (believe me I had come up with some pretty crazy things that might go wrong during my wait lol!) but you should be just fine.

As far as income and stuff goes (I am a U.S. citizen my husband was the U.K. citizen), I had no income due to various issues, my husband made a little under £30,000 a year and they let me in! And as for housing we stated on the application we were going to be living at his Mum's house until I started working so....with all of that THEY STILL LET ME IN.  :)

So....have a cup of tea/coffee/hot chocolate/whatever beverage you like, and start preparing for your husband to be with you all the time!  ;D

Everybody freaks out at about the same time as you.  Visa applications are emotive because they are all about family formation and family reunion, and that's a pretty critical aspect of someone's life.  And we don't like to turn control of our lives over to a process that we don't know anything about and could be massively disruptive to our plans.

Additionally, it's not something people do every day.  In fact people submit settlement applications about once in their life, so it's unfamilar turf.  But at 30K Sterling, you're well above the norm as far as these things go.

If your passport was certified by a member of the Law Society (or US equivalent), that's fine.  When I was in practice, I used to certify copies of passports all the time for spousal applications.  Not a big deal.  And if they don't like the certified copy, you still have 28 days to lay the real thing before them.  I wouldn't worry about it.

Actually those numbers relate to all settlement-class visas together ..... spouse, fiance(e), Civil partner, etc.. They don't publish statistics for each one separately.

If you really are finding it difficult to sleep, download this document. In particular go to page 25 of 155. There you will see that during the year in question the rejection rate for the four North American missions was just 2%.

On page 27 of 155 you will see that for Kingston, Jamaica, the rejection rate was 64%!

Those statistics are for 2005-2006  ......  the year to 31 March 2006. They did publish some statistics for 2006-2007, but they do not include detailed numbers for settlement visas applications. No statistics have been issued yet for 2007-2008.

No bank statements at all? He has no bank account?

Hi John

He has not sent any bank statements as since is has been unemployed for around 7 months and I have been sending him money. He hasnt used his bank for around that amount of time, not even sure it is still active. He uses my bank for most things. Will this be a problem?

Even though the bank account is unused, I think the bank statements should still be submitted. After all such statements are clearly on the needed list.

Hi John
The bank he used to use has closed his account due to inactivity so any bank statments would be at least 9 months old. Should this have been something we mentioned on the application?

To make matters worse I just found out that he gave his permaent address when he did his biometrics yesterday. The application was submitted with his mailing address where he currently resides. Has this screwed things up? Help, I feel sicker than ever  [smiley=puke.gif]
