Work Permit Extra Income - Subletting?

My Partner and I were discussing housing options and we had decided that what we would like to do is to rent out a 3 bedroom house ourselves and have his brother move into the house with us and "sublet" a room from us.

Will this count against me as extra income? Can I avoid this by having him pay his portion of the rent directly to the letting agent?

Let me know....I don't want to get in trouble for appearing to take in extra "income".

BTW - My boyfriend is on incapacity benefit (medical condition) and he is unsure about whether he can put any money into his account without it affecting his benefit as well. Otherwise we would do the obvious and have the brother pay into my partner's bank account.

I am hoping we can work this out because we would really love to have his brother live with us.

First of all, there is no problem with this according to the immigration rules.

However, most contracts will not allow subletting.  You can rent a three bedroom house and share the cost with your brother, by having him on the tenancy, but I am not sure it will make you money (though it may cut your living costs).

We actually found 2 places that wouldn't mind us subletting (shocking!) which we would prefer to do so we aren't "tied in" if it doesn't work out after a few months.

I once saw a post where a girl got in serious trouble for taking a babysitting job for the neighbors while on a WP, so that made me nervous!

It wasn't going to be worth it if it got me in trouble. It seemed nonsensical that I wouldn't be allowed to sublet out a room....but many things about this process have been counterintuitive.
