Completely confused on filing
« on: February 03, 2009, 09:10:59 AM »
I know there are plenty of people asking questions so maybe if someone knows what is going on, perhaps they can shed a bit of light on things for me.
Married in January 2008
Worked up till June 30th 2008
Moved to UK July 26th 2008
Started working in the UK on November 1st 2008
I sent an email to the US embassy London about whether or not I need an extention due to the 330 days requirement.
One reply said yes I would need an extention and to file a 2350 sheet.
The other reply said that no and I should be able to file by the June deadline.
So do I or don't I?

I thought taxes are due in April.  What is this June deadline they speak of?
Someone please help!  :\\\'(

Overseas citizens get an automatic extension until June.

Correct.  You file a Form 2350 so you have enough time to qualify for the foreign earned income exclusion.

Thank you

One last dumb question from me
Do I file as married but separate?  Do I file as single?  My husband would never file for US taxes so all this stuff about whether it will file itemized or not is totally throwing me off.

Thank you so much for the help!

You can only file as single if you can sign under penalties of perjury that you are single.  Would your husband forgive you?

I understand i can't file single since I am married but where does he fit in?

I can't file a joint since he has nothing to file but if I file separate, does that not imply that he will file?  It's like I am filing half and at some point they are expecting the other half that will never come?

You file married filing separate and in the blank where his ss# goes you write NRA (non-resident alien) unless he has an ITIN, which he most probably does not.
