Bona Fide Residence or Physical Presence on 2008 taxes?
« on: February 03, 2009, 12:28:34 PM »
I have looked at various things regarding claiming bona fide residence or physical presence; but, I am still confused.

I could claim either one as I have lived in the UK since November 2007.

For me, would it be best to do Bona Fide Residence since I travel a great deal for work?  I am afraid that my business trips will eventually knock me out of the requisite 330 days.

Advice?
I am the architect of my destiny.

I can't necessarily say I have advice, but I have been working on our taxes and found this explanation of the different between Bona Fide v Physical Presence VERY helpful:

Almost everyone goes for BFR unless they do not qualify (eg they are a green card holder).

Don't forget you have to allocate the income relating to US business days as US source for the foreign earned income exclusion and the foreign tax credit plus you doubtless will also need to file State returns if you worked in State(s) with an income tax.
