unemployed vs employed on spousal application

Hello there... Lovely day today for me: I'm pretty sure I just found out I'm getting laid off. Not official yet, but looking very promising.   [smiley=sick.gif]
Of course that is not really good news since my DH and I were not planning on me moving until December and now this may drastically (suddenly, scarily, etc!!) change our plans. 

Question is: should I panic and fill out the application while I can say I am still employed or will that even make a difference in the sucess of our application since clearly I would become unemployed when I move anyway?

I was unemployed when I got my spousal visa.  The important thing is that your finances meet the requirements, so your sponsor's income is the crucial bit.  Is there anything keeping you in the US except your job?

Urgh, sorry to hear that, I'm sure it made your day :( As for a spousal application, I don't think it necessarily hurts to be unemployed; it all just depends on the financial situation between you and your husband, since they consider you two as a couple. If you guys can still meet the financial requirements, then I don't see it making a huge difference one way or the other. If it does, then I'm in trouble  :-\\\\

First of all, I am very sorry!

As to your visa, is your husband employed? Cause if he's employed and can sufficiently support you both, you losing your job shouldn't be a huge issue. If you're both gonna be unemployed, what do you anticipate will be the level of your savings (his and your combined) when you're planning on filing?

Yes, he is employed and can cover the necessary expenses with the 95GBP/week left over.   I was hoping to submit a budget with my potential income based off of available jobs in our area in the UK.  Can I still do that even if I dont have a job here?  I guess just b/c I got laid off doesnt mean I am not employable, right??  (someone remind me of this, please!)

There are other things keeping me in the US for a few months anyway - mostly my dog and I also own a house which I hope to rent.  I just called and had a good cry to my dad and he reminded me I could live there for as long as I wish and pay bills I would still have with the unemployment benefits I should/hope to get.

Ugh.  This was not supposed to happen this way....

I don't think you should include your potential earnings in your budget. Better be safe, and just include his. However, there's nothing stopping you from additionally submitting your CV with your app, along with a printout from a job site like Monster or something with a list of ads for openings in your geographical area that might be appropriate for you. That would probably be a better way of handling it.

I doubt they'd consider "potential earnings" because nothing is guaranteed.  But if you can meet the £95/week on your husband's salary, then don't waste your energy stressing.

You're totally employable, it's just a bad time where a lot of qualified people are getting the axe through no fault of their own :( So I think you'll do great in the UK, and since your husband can make the requirements, I don't think you'll have anything to stress about in terms of your visa :)

Whether or not you have a job in the UK makes no difference at all.  It's all about your income/savings once in the UK.

If this is borderline then it may be worth showing that you have plenty of job opportunities in the UK.  I often do that when making applications for people with low incomes.

Sorry to hear about the layoff Carey!! However, in the end, it may just be the best thing- you get to move with your hubby 4 months earlier! :) And if you're biding time till you sell/rent the house and can get your dog out of quarantine, why not do it in the UK and fly back to the States when it's time to get doggy! :)
